Permit Issuance. 10.1.1 NMFS issuance of a Permit to the District assures the District that based upon the best scientific and commercial data available and after careful consideration of all comments received, NMFS has found that with respect to all Permit Species that: (i) any take of a Permit Species by the District under this Agreement will be incidental to the carrying out of otherwise lawful activities; (ii) under this Agreement the District will, to the maximum extent practicable, minimize and mitigate any incidental take of Permit Species; (iii) the District has sufficient financial resources to adequately fund its affirmative obligations under this Agreement; (iv) as long as the actions required by this Agreement to minimize/mitigate incidental take are implemented, any incidental take of a Permit Species will not appreciably reduce the likelihood of the survival and recovery of such species in the wild; and (v) other measures and assurances required by NMFS as being necessary or appropriate are included in this Agreement. The hatchery permits are addressed in Section 10.1.4.

Permit Issuance. 10.2.1 The District shall revise its incidental take permit applications for Permit Species based upon this Agreement and submit a directed take permit application for Hatchery Operations. This Agreement and its Figures and Appendices shall constitute the District’s habitat conservation plan in support of the District’s incidental take permit application. Supporting Documents A, B, C and D are to be used as supporting documents to the Agreement and as such, Supporting Documents A, B, C and D do not, by themselves, create contractual obligations under this Agreement or through the permit issued by NMFS.
Permit Issuance. If IDEQ’s final determination is to issue the permit, the permit will be forwarded to the permit applicant, along with a transmittal letter conveying IDEQ's decision. An electronic copy of the final issued permit and fact sheet will be made available to EPA.

Permit Issuance. Tacoma Power may approve an Application if, in its sole judgment, exercised reasonably, Tacoma Power determines that it (1) has sufficient Capacity to accommodate the requested Attachments, (2) Licensee meets all the requirements set forth in this Agreement, and (3) the Attachment and Application complies with all Applicable Standards. Upon approval, Tacoma Power shall send Licensee an executed Permit substantially in the form of Appendix A, Pole Attachment Permit, consenting in whole or in part to the Attachments requested in the Application. This Agreement shall not in itself constitute any such consent.
Permit Issuance. CDRI’s Regional Roadway Project obligations identified in Exhibit F and the Project Table will be fully satisfied upon CDRI: (i) making the required cash in lieu of construction payments to the City for Projects 1-11; and (ii) constructing Project 12 or making a cash in lieu of construction for Project 12 pursuant to section 4.7(e) above. Once CDRI’s obligations related to Regional Roadway Projects are satisfied, CDRI may continue to request Building Permits, and the City shall continue to issue such Permits irrespective of whether the City has completed construction of the roadway improvements for which CDRI has made a cash in lieu of construction payment to the City.
Permit Issuance. Upon the execution of this Agreement, the City shall issue permits necessary to complete the Project, and the other activities/improvements required by this Agreement, provided, however, the required Architecturally or Engineered stamped, construction drawings shall be submitted to the City by State Licensed Contractors and follow all applicable State of Michigan and International Codes, and comply with the City of Madison Heights current site standards. Further, upon submission of any future permit applications by Developer during the term of this Agreement, the City shall issue permits necessary to complete any activities/improvements to the Project, provided, however, the required Architecturally or Engineered stamped, construction drawings are submitted to the City by State Licensed Contractors and are in compliance with all applicable State of Michigan and International Codes and comply with the City of Madison Heights site standards.

Permit Issuance. The City will issue a Permit(s) to GLEC only when the City determines, in its sole judgment, exercised reasonably, that (i) GLEC meets the requirements set forth in this License, and (ii) such permit(s) comply with all applicable laws, regulations and standards. To construct GLEC Facilities in new locations within the City boundaries pursuant to this License, GLEC will use the City permitting process, follow all application and reporting steps required by that process, and submit updated copies of the system route map to the City.
Permit Issuance. No application will be approved until receipt of full payment. Once an application is approved, no refunds will be issued for any reason. Issuance of permits will be determined by the order in which approved applications are received. Permittee may not assign an approved application without prior written consent of the CITY OF SARASOTA (“CITY”).
Permit Issuance. 5.2.1 Upon satisfaction of the Tow Truck Permit inspection requirements of this Agreement, the Sheriff’s Office may issue the Company a Tow Truck Permit. Such issuance is at the sole discretion of the Sheriff’s Office.
