Perishable Goods. Goods of a perishable nature are carried in dry trailers without environmental or atmospheric control or other special services unless Shipper states on the face of the “Service Request and Shipping Instructions” that the goods are to be carried in a refrigerated, heated, specially ventilated or otherwise specially equipped trailer. This carriage may be subject to additional charges. Shipper is re- sponsible for bringing the goods to the proper temperature before loading the goods into the trailer, for the proper stowage of the goods within the trailer, and for setting the temperature (including maintenance and repair), during all times after the trailer is spotted by Xxxxxxx and before the trailer is received by Xxxxxxx. Xxxxxxx is not responsible for product deterioration caused by inherent vice, defects in the merchandise or transit times in excess of product shelf life. Refrigerated, heated, specially ventilated or otherwise specially equipped trailers are not equipped to change the temperature of goods (they are equipped only to maintain temperature). Shipper will give written notice of requested temperature setting of the thermostatic controls before receipt of the goods by Xxxxxxx. When a loaded trailer is received, Xxxxxxx will verify that the thermostatic controls are set to maintain trailer temperature as requested. Xxxxxxx is unable to determine whether the goods were at the proper temperature when they were loaded into the trailer or when the trailer is delivered to Xxxxxxx. Air temperature at the unit sensor will be maintained within a proper range of plus or minus 5 degrees Fahrenheit of the temperature requested by Shipper on the face of the “Service Request and Shipping Instructions” if the goods were at that temperature when loaded into the container and if the temperature controls were properly set when the container was loaded.
Perishable Goods. 1. With a view to preventing avoidable loss or deterioration of perishable goods, and provided all regulatory requirements have been met, each Party shall:

In the disputes related to perishable goods, the Parties and the panel referred to in Article XIII.07 shall do everything to accelerate the procedure to the maximum extent possible. For this purpose, the Parties shall try to reduce by mutual agreement the time frames established in this Chapter.
Perishable Goods. 1. For the purposes of this Article, perishable goods are goods that rapidly decay due to their natural characteristics, in particular in the absence of appropriate storage conditions.
Perishable Goods. 1. On disputes regarding perishable goods 1 , the Parties and the panel referred to in Article 15.07 may expedite the procedure. For this purpose, the Parties shall, by mutual agreement, shorten the timeframes established in this Chapter. 2. In cases of urgency, including issues regarding perishable goods, the consultations shall begin within fifteen (15) days upon receipt of the request.
Perishable Goods. Perishable goods which are not taken up immediately upon arrival at their destination or which are insufficiently marked or otherwise not identifiable may be disposed of without notice to the customer, and payment or tender to the customer of the net proceeds of any disposition (after deduction of all charges incurred by SPACIOUS) shall be equivalent to delivery.

If the Goods forming a Client Order are perishable or liable to deteriorate, MSL UK LTD has the right to sell or dispose of the Goods immediately upon the failure of the Client or its appointed agent to take delivery in accordance with the Client Order. However, MSL UK LTD will take reasonable steps to notify the Customer of its intention to sell or dispose of the Goods before doing so.
Perishable Goods. If the Goods are perishable or liable to deteriorate, MSL UK LTD's right to sell or dispose of them arises immediately upon any sum becoming due and unpaid. However, MSL UK LTD will take reasonable steps to notify the Customer of its intention before proceeding with the sale or disposal.
