Period of Delivery. Except when agreed upon in writing, the period of delivery is only stipulated as an indication and the non- observance thereof does not give the Buyer any right of recourse.
Period of Delivery. Commencing July 1, 1999 through February 28, 2010, unless Seller exercises its right to extend prior to December 31, 2009, in which case the Period of Delivery shall extend through February 28, 2013.
Period of Delivery. 8.1 The indications concerning the period of delivery apply to the finishing of the object of the supply in the works of the supplier. Only those periods of delivery which are fixed in the written offer or the confirmation of order are binding. The Buyer is obliged to accept the delivered goods, having carried out from its part all the actions necessary to ensure the purveyance and acceptance of goods, in particular: 3.3.1. The Buyer shall at its own expense provide the Seller on driveways last as per railway details, specified in Section 13 hereof, rail tank cars, suitable for loading in an amount necessary for the timely shipment of the goods; 3.3.2. The Buyer is obliged to ensure the timely arrival of rail tank cars on the driveway of the Seller, adequate technical and commercial conditions of such rail tank cars, and the availability of documents, confirming the possibility of loading the goods into the rail tank cars Without such documents the loading of the goods into the rail tank cars, provided by the Buyer is not carried out. Shipment of the goods is carried out by the Seller subject to the availability of rail tank cars, provided by the Buyer on the driveways of the Seller. The Buyer bears all responsibility and risk, associated with the use of rail tank cars, provided by the Buyer from the moment of loading of the goods in such rail tank cars. In the event of the Seller's losses, associated with the use of rail tank cars, provided by the Buyer, the latter, at the Seller's request, it is obliged to compensate such losses. 3.3.3. The Buyer is obliged to notify the Seller shipping details no later than two (2) days from the departure date of the Seller`s (via e-mail or fax) notification of readiness for shipment of the goods. If the shipment of the goods produced in the address of the consignee, which is not a Buyer under the contract, the Buyer is responsible for the accuracy of the details of the consignee of the goods and acceptance of them. 3.4. Shipment of goods on behalf of the Seller shall carries out "Trading house- Ukrtatnafta" (consignor). 3.5. The Seller is deemed to fulfill its obligation to deliver the goods from the moment of its transfer to the disposal of the transport organization (carrier). The Seller is not responsible for the loss of the goods, which arose after the transfer to the transport organization (carrier). Period of Delivery. 1. Delivery dates stated by Xxxxx Water GmbH are non-binding estimates, unless expressly stipulated in writing as contractual deadlines or binding delivery dates.
Period of Delivery. 4.1 Specifications on the period of delivery are considered as approximation, unless a fixed pe- riod or a fixed date has been assured or agreed upon. If shipment has been agreed be- tween the parties, period and dates of delivery refer to the time of transfer to the carrier, freighter or other person instructed to transport the goods.
