Where an employee has worked irregular hours, the average hours worked in the 3 months prior to termination will be used to calculate any redundancy payments payable under this clause. The redundancy payments must not exceed the amount which the employee would have earned if employment with Travellers Aid had proceeded to the employee's normal retirement date. If Travellers Aid is able to obtain an offer of suitable alternative employment for an employee there will be no obligation to pay redundancy under this Agreement, even if the employee does not accept the offer. The redundancy payment in this clause is not payable in circumstances where, due to a restructure or transmission of business, an employee's position is made redundant, but Travellers Aid is able to procure an offer of employment for the employee, on similar terms and conditions. A reduction in rostered hours or change in location, will not be sufficient to entitle an employee to redundancy payments if the other terms remain similar to those previously received by the employee. Should Travellers Aid have less than 15 employees (including casual employee) at the time employees are made redundant, then no redundancy will be payable under this term.

This is consistent with the 2004 Redundancy Case decision made by the Australian Industrial Relations Commission. Employees whose position is made redundant after 10 years or more of service will receive only 12 weeks' pay, to avoid 'double counting' for employees who receive pro rata long service leave entitlements.
