Performance Test Procedures. Contractor shall develop the Performance Test Procedures (for both the Five Consecutive Day Operational Test and the Five Day Performance Ratio Test) in accordance with Exhibit H and shall provide the Performance Test Procedures for Owner’s review and approval, as soon as reasonably practicable after Contractor’s receipt of the Notice to Proceed (but in no event later than sixty (60) days prior to the commencement of the first Performance to be conducted by Contractor hereunder). Owner shall have thirty (30) days from the date it receives the Performance Test Procedures to review and provide comments to Contractor. Contractor shall incorporate all of Owner’s reasonable comments into the final Performance Test Procedures, which shall be approved by Owner (such approval not to be unreasonably withheld). Performance Test Procedures. Each Performance Test shall be conducted in general accordance with [ASME Performance Test Code 46 for Combined Cycle facilities, ASME Performance Test Code 22 for simple cycle Gas Turbine facilities or ASME Performance Test Code 17 for Reciprocating Internal Combustion Engine facilities, depending on the technology of the Facility], and in accordance with the procedures set forth in subsections (i) through (xi) below, including additional procedures and protocols related to Performance Testing as mutually agreed between Buyer and Seller (“Test Procedures”).

Performance Test Procedures. The test procedures for each of the Performance Tests are set out in general detail in this Attachment S. Contractor shall, no later than one hundred eighty (180) Days prior to the scheduled date for commencement of Performance Tests for the first Unit (as shown by the then-current CPM Performance Measurement Baseline Schedule), submit to Owner for Owner’s comment and approval, proposed procedures, meeting the requirements set forth in this Attachment S, for each of the Performance Tests. Such proposed procedures shall include pre-test uncertainty calculations. Thereafter, the Parties shall meet and mutually agree upon written test procedures for all Performance Tests, and all such written test procedures shall be agreed upon at least ninety (90) Days prior to the commencement of any Performance Test.
Performance Test Procedures. Commissioning Agent shall prepare a Functional Test plan for each system, assembly, and item of equipment being commissioned. Each Functional Test plan shall provide a detailed description of the test procedures to be used to verify proper system/equipment operation.
Performance Test Procedures. Each Performance Test will be conducted in general accordance with applicable CAISO requirements and ASME and other applicable test codes, depending on the technology, Products, and Operational Limitations, and in accordance with the procedures set forth in subsections (i) through (vi) below, including additional procedures and protocols related to Performance Testing as mutually agreed between Buyer and Seller (“Test Procedures”). Buyer and Seller shall mutually develop Test Procedures for a Performance Test. Seller shall prepare proposed Test Procedures based upon Appendix VI-2 and provide these to Buyer for Buyer’s review and approval at least one hundred and eighty (180) days prior to the Initial Delivery Date. The Parties shall finalize mutually acceptable Test Procedures at least thirty (30) days prior to the Initial Performance Test. Buyer and Seller shall mutually develop any changes to the Test Procedures. Seller shall provide such changes to Test Procedures for Buyer review and approval prior to implementation of such changes.
Performance Test Procedures. Buyer and Seller shall mutually develop Test Procedures to verify the Project’s ability to accept Charging Energy, deliver Product, and operate according to the Operational Limitations specified in Appendix II. Performance Test Procedures. Contractor shall provide Owner, for Owner’s review and approval, detailed performance correction curves not later than one hundred twenty (120) days after the Full Notice to Proceed Date. Such correction curves shall be supplied in accordance with the requirements in Exhibit M. Contractor shall provide Owner, for Owner’s review and approval, detailed Performance Test Procedures and procedures for the start-up and commissioning of the Facility (each prepared in accordance with Exhibit M) not less than one hundred twenty (120) days prior to the anticipated start of commissioning activities. Contractor and Owner shall cooperate reasonably to reach agreement on the Performance Test Procedures to be followed by Contractor not less than sixty (60) days after receipt of the same.
Performance Test Procedures. Contractor shall provide Owner, for Owner’s review and approval, detailed Performance Test Procedures and procedures for the start-up and commissioning of the Power Plant (each prepared in accordance with Exhibit “I”) not less than one hundred twenty (120) days prior to the date on which Contractor anticipates the commencement of the Performance Tests. Contractor and Owner shall cooperate reasonably to reach agreement on the Performance Test Procedures to be followed by Contractor not less than sixty (60) days prior to the date on which Contractor anticipates commencing the Performance Tests, and in any event prior to the start-up and commissioning of the Power Plant.
Performance Test Procedures. No later than two hundred forty (240) Days prior to the Guaranteed Substantial Completion Date of Stage I, Contractor shall propose to Owner for its review and acceptance detailed final test procedures for the conduct of Performance Tests, and the functional tests as described in Appendix G, with respect to each Stage, including for Stage I, detailed final test procedures with respect to the LNG Tanks and the other Common Facilities; provided that Contractor shall endeavor to provide such test procedures no later than two hundred forty (240) Days prior to the Target Substantial Completion Date if earlier than the Guaranteed Substantial Completion Date. Contractor’s proposed test procedures shall incorporate all of the requirements and comply with the conditions of testing described in Appendix G. Once Owner has accepted final test procedures for the conduct of the Performance Tests and the functional tests described in Appendix G for such Stage (the “Performance Test Procedures”), the Performance Test Procedures shall form a part of the requirement for the conduct of the Performance Tests. Thereafter, either Party may propose changes to a Performance Test Procedure at any time up to sixty (60) Days prior to commencement of the initial functional test as described in Appendix G or the initial Performance Test, as applicable, and each Party agrees to cooperate in good faith in evaluating such change. No change shall be effective, however, without written acceptance of Owner and Contractor.
