Payments to the Designer Sample Clauses

Payments to the Designer during the execution of the Work and in proportion to the amount of services rendered by the Designer on account of Services A, B, C, D or E in the Agreement, shall be made until the aggregate of all payments made are equal to the percentages on the Basic Fee Schedule arising from the Agreement computed on the Cost of Work as defined above and/or modified.

Payments to the Designer. 7‑1 Payments on account of the Designer's basic services shall become due and payable in an amount sufficient to increase the compensation for basic services to the following percentages of the basic fee upon completion of the phases of work as indicated hereinafter; monthly payments may be made if progress is satisfactory to the Owner. Payments are not to exceed the stated percentages.

The Designer agrees to begin work on the Project promptly upon receipt of his fully executed copy of the Agreement and to pursue his work in accordance with the following schedule: DESIGNER's PRODUCTION SCHEDULE PHASE DATE Schematic Design Design Development Working Drawings (aka Construction Documents): Estimate “Out To Bid” Date: It is the responsibility of the Designer to maintain the above production schedule. If for any reason it appears any phase of the project will be delayed, the designer shall notify the Owner and the State Construction Office, in writing, prior to the due date of that phase with an explanation of the reason(s) for the delay. If the delay(s) are approved by the Owner and the State Construction Office, the schedule may be modified and the agreement amended. Both failure to give the required notification of delay and failure to meet the production schedule constitute failure to perform in accordance with the terms of this Agreement and the Agreement may be terminated in accordance with Article 10-2.

  • PAYMENTS TO THE CONSULTANT (a) Payments of undisputed amounts are due and payable within sixty (60) days after the City’s receipt of an invoice from the Consultant. Undisputed amounts unpaid after sixty (60) days from the City’s receipt of such invoice shall bear interest at the rate of three percent (3%) per annum.

  • PAYMENTS TO THE ARCHITECT/ENGINEER 6.1. In all events, the ARCHITECT/ENGINEER shall submit his/her completed itemized accounting of all costs monthly to the State, and the State shall make all payments within 30 days of receipt of an error-free invoice.

We may modify a Service at any time without degrading its functionality or security features For current subscriptions, we may degrade the functionality of a Service or discontinue a Service only in case of (i) legal requirements; (ii) changes in the Services imposed by Siemens’ subcontractors; (iii) the termination of our relationship with a provider of software and/or services used by us which are material for the provision of such Service; (iv) lack of customer acceptance; and/or (v) security risks. We will notify you of any material degradation of functionality or the discontinuation of a Service and the effective date at least 80 days prior to such change, and you may terminate the modified Service 30 days prior to the change effective date. In the event of such termination or discontinuation of a Service, we will refund any prepaid amounts for the applicable Service on a pro-rata basis for the remaining Subscription Term. We do not maintain prior versions of a Service.

  • RIGHT OF ALLOTTEE TO USE COMMON AREAS AND FACILITIES SUBJECT TO PAYMENT OF TOTAL MAINTENANCE CHARGES The Allottee hereby agrees to purchase the [Apartment/Plot] on the specific understanding that is/her right to the use of Common Areas shall be subject to timely payment of total maintenance charges, as determined and thereafter billed by the maintenance agency appointed or the association of allottees (or the maintenance agency appointed by it) and performance by the Allottee of all his/her obligations in respect of the terms and conditions specified by the maintenance agency or the association of allottees from time to time.

  • Payments Comprising the Fund Payments made to the Trustee for the Fund shall consist of cash or securities acceptable to the Trustee.
