Payments to PSP. PSP shall be paid in accordance with Chapter 2251 of the Texas Government Code, also known as the “Prompt Payment Act” and the provisions set out in Article 10 of the UGC, subject to any Special Conditions. Any Professional Services performed or delivered by PSP prior to the Effective Date of this Agreement or after its termination cannot be compensated.

Payments to PSP. Payments to PSP shall be made monthly in proportion to the services performed. PSP shall be paid in accordance with Chapter 2251 of the Texas Government Code, also known as the “Prompt Payment Act”.
Payments to PSP. PSP shall present monthly Applications for Payment to the Owner detailing the PSP’s Services and approved Additional Services performed and the approved Reimbursable Expenses incurred for the Project in the previous month. With each application for payment, PSP shall submit payroll information, receipts, invoices and any other evidence of payment which Owner or its designated representatives shall deem necessary to support the amount requested. Owner shall promptly review the Application for Payment and notify PSP whether the Application is approved or disapproved, in whole or in part. Owner shall promptly pay PSP for all approved services and expenses. For purposes of Texas Government Code § 2251.021(a)(2), the date performance of services is completed is the date when the Owner's representative approves the Application for Payment. Owner shall have the right to withhold from payments due PSP such sums as are necessary to protect Owner against any loss or damage which may result from negligence by PSP or failure of PSP to perform its obligations under this Agreement.

  • PAYMENTS TO CONTRACTOR (a) Payments to Contractor will be made on a monthly basis and within thirty (30) days from receipt of a correct invoice or billing statement in accordance with the Texas Government Code, Chapter 2251, known as the Texas Prompt Payment Act.   • Disbursements to Contractors to Pay Costs of the Project The Recipient shall require that as work on the Project and as specified in its contract is performed a Contractor shall promptly submit a detailed project specific invoice to the Project Manager. Within three (3) Business Days following receipt of such invoice from a Contractor, the Project Manager shall review the invoice and, if found to be accurate, shall so certify in writing, forwarding such certification together with a copy of the invoice to the Chief Fiscal Officer. Within five (5) Business Days following receipt of such invoice and certification from the Project Manager, the Chief Fiscal Officer shall conduct such reviews as he considers appropriate and, if he approves such invoice, shall submit to the Director a Disbursement Request together with the information and certifications required by this Section 6(b). The dollar amount set forth in the Disbursement Request shall be calculated based on the Participation Percentage as set forth originally in Appendix D of this Agreement or as may be adjusted from time to time to account for changed conditions in the project financing scheme. Within five (5) Business Days following receipt of the Disbursement Request and all required information and certifications, the Director shall, if such items are deemed by the Director to be accurate and completed, initiate a voucher in accordance with applicable State requirements for the payment of the amount set forth in the Disbursement Request. Upon receipt of a warrant from the Auditor of State drawn in connection with a voucher initiated in accordance with the terms of the preceding sentence, the Director shall forward it by regular first class United States mail or electronic funds transfer, to the contractor or other authorized recipient designated in the Disbursement Request. Prior to any disbursement from the Fund, the following documents shall be submitted to the Director by the Recipient:
