Payments to Engineer. A. Preparation and Payment of Invoices. Invoices will be prepared in accordance with ENGINEER’s standard invoicing practices. Invoices are due and payable upon receipt. If OWNER fails to make any payment due ENGINEER for services and expenses within 30 days after receipt of ENGINEER’s invoice therefore, the amounts due ENGINEER will be increased at the rate of 1.0% per month (or the maximum rate of interest permitted by law, if less) for said thirtieth day. In addition, ENGINEER may, after giving seven days written notice to OWNER, suspend services under this Agreement until ENGINEER has been paid in full all amounts due for services, expenses, and other related charges. Payments will be credited first to interest and then to principal.

(HDR) is pleased to provide you with this fee proposal for Preliminary Engineering Services to evaluate replacement options for the gravity sanitary sewer trunk main and Cemetery Road Lift Station that are along FM 517 from FM 646 to Cemetery Road. For your convenience, this proposal consists of a General Overview, Scope of Services, Fees, Schedule, and Terms and Conditions Sections. GENERAL OVERVIEW: The Galveston County Water Control and Improvement District No. 1 (District) has existing water line and sanitary sewer facilities within District owned utility easements and rights-of-way on each side of FM 517 from Cemetery Road to Xxxxxx Xxxx just west of Interstate Highway 45. FM 517 is owned and maintained by the Texas Department of Transportation (TxDOT) and since 2016 TxDOT has been in the design process of widening FM 517 from FM 646 to Highway 35 in Alvin. This widening is expected to take anywhere from thirty (30) feet to sixty (60) feet of additional right-of-way on one or both sides of FM 517 which will impact the District’s existing water and wastewater facilities in the area. On April 6, 2022, District Staff and HDR attended a 30% Utility Coordination Meeting with TxDOT and their Design Engineer (Woolpert) to get an update on the FM 517 widening project. After this meeting, TxDOT shared their 30% design plans, roadway cross-sections and utility conflict matrix. HDR’s review of this information confirmed that the District’s existing 10-inch / 12-inch water lines, 15-inch thru 30-inch gravity sanitary sewer trunk mains, and portions of the Cemetery Road Lift Station will be impacted as a result of this widening project.
