Payment of Workers and Subcontractors. The Contractor must with each payment claim submitted under clause 12.2 provide the Contract Administrator with a duly completed declaration in the form set out in the payment claim (in the format set out in the Schedule of Collateral Documents) for each applicable jurisdiction in which the Contractor's Activities were carried out during the relevant period.

Payment of Workers and Subcontractors. Option 1 (All Other States and Territories) The Contractor must with each payment claim under clause 11.2 provide the Contract Administrator with: a statutory declaration, together with any supporting evidence which may be reasonably required by the Contract Administrator, duly signed by the Contractor or, where the Contractor is a corporation, by a representative of the Contractor who is in a position to know the facts declared, that, except to the extent disclosed in the statutory declaration (such disclosure to specify all relevant amounts, workers and subcontractors): all workers who have at any time been employed by the Contractor in connection with the Contractor's Activities have at the date of the payment claim been paid all moneys due and payable to them in respect of their employment in connection with the Contractor's Activities; and all subcontractors have been paid all moneys due and payable to them in respect of the Contractor's Activities; and documentary evidence that, except to the extent otherwise disclosed (such disclosure to specify all relevant amounts and workers), as at the date of the payment claim, all workers who have been employed by a subcontractor have been paid all moneys due and payable to them in respect of their employment in connection with the Contractor's Activities. The Principal is entitled to withhold from any payment which would otherwise be due to the Contractor under the Contract, the amount disclosed as unpaid under this clause 11.14.
Payment of Workers and Subcontractors. Option 2 (New South Wales Only) The Contractor is not entitled to give the PDS Contractor a payment claim under clause 11.2 and the Commonwealth is not obliged to make any payment under clause 11.5 unless the Contractor has provided the PDS Contractor with: a supporting statement (as defined in section 13(9) of the Building and Construction Industry Security of Payment Act 1999 (NSW)) and prescribed by the Building and Construction Industry Security of Payment Regulation 2008 (NSW); a written statement for the purposes of, and which complies with, section 127 of the Industrial Relations Act 1996 (NSW), section 175B of the Workers Compensation Act 1987 (NSW) and Schedule 2 Part 6 of the Payroll Tax Act 2007 (NSW) which is in a form approved by the PDS Contractor and covers the period of the relevant payment claim; and evidence of compliance with its Workers Compensation Insurance obligations under clause 4.3.

Payment of Workers and Subcontractors. 18.1 WORKERS AND SUBCONTRACTORS The Contractor must pay all moneys due and payable to subcontractors in respect of work under the Agreement as and when due. If required by the Customer, the Contractor shall with each progress claim and, to the extent not prohibited by law, as a precondition to the Customer becoming obliged to make any payment to the Contractor arising out of such progress claim give in respect of a progress claim a statutory declaration by the Contractor or, where the Contractor is a corporation, by a representative of the Contractor who is in a position to know the facts declared, that all subcontractors have been paid all moneys due and payable to them in respect of work under the Contract.
Payment of Workers and Subcontractors. At least 14 days before the date the Principal is required to make a Progress Payment to the Contractor, or at any other time requested by the Superintendent, the Contractor shall provide a statutory declaration (in a form approved by the Principal) declaring that all workers, subcontractors and suppliers have been paid any amounts due and payable to them as at the date of the payment claim. The Principal is not obliged to pay any amount until the Contractor has complied with its obligations under this clause. Where requested by the Superintendent following receipt of a statutory declaration under clause 42.1, the Contractor shall also provide documentary evidence to support the declaration and a list of the names and contact details of each subcontractor and supplier engaged to perform the Works, within 5 days of the Superintendent’s request. The provision of the statutory declaration and additional documentary evidence, if applicable, shall be a condition precedent to any entitlement to payment. The Principal may, at its discretion, make a payment directly to a worker, subcontractor or supplier where: the Contractor requests in writing; or the worker, subcontractor or supplier requests in writing and provides a Court Order or adjudication determination evidencing money due and payable by the Contractor in connection with this Contract. Where payment is made by the Principal under clause 42.4, it shall be deemed to be a payment to the Contractor in satisfaction of the Principal’s payment obligations under this Contract. For the avoidance of doubt, the Contractor consents to the Superintendent and the Principal contacting the Contractor’s workers, subcontractors and suppliers for the purpose of auditing a statutory declaration provided under this clause.
