Payment of Property Charges. 2.10.1 Borrower has elected to require Lender to use Loan Advances to pay property charges consisting of taxes, hazard insurance premiums, ground rents and special assessments if indicated on the attached payment plan (Exhibit 1). Borrower may change this election by notifying Xxxxxx and at that time Xxxxxx shall pay to Borrower any amounts withheld from the Loan Advances to pay property charges.

Payment of Property Charges. Unless and to the extent contested by the Mortgagor in accordance with the provisions of the Credit Agreement, the Mortgagor shall pay and discharge, or cause to be paid and discharged, from time to time prior to same becoming delinquent, all Property Charges. The Mortgagor shall, upon the Mortgagee’s request, deliver to the Mortgagee receipts evidencing the payment of all such Property Charges.
Payment of Property Charges. If Borrower fails to pay the property charges in a timely manner, Lender may pay the property charges; however, such election shall not preclude the Lender from taking action due to the Borrower’s failure to pay property charges under this section.

Those charges for the year in which the Right of Superficies is created will be settled between the Parties on and as of the Transfer Date in proportion to the time elapsed. Lender may require Borrower to pay specified property charges directly to the party owed payment even though Xxxxxx pays other property charges as provided in this Paragraph.
