Common use of Payment in Lieu of Benefits Clause in Contracts

Payment in Lieu of Benefits. (a) A part-time nurse shall receive in lieu of all fringe benefits (being those benefits to a nurse, paid in whole or part by the Employer, as part of direct compensation or otherwise, save and except salary, shift premium, vacation pay, standby pay, call-back pay, reporting pay, responsibility allowance, jury or witness duty, and bereavement pay) an amount equal to thirteen percent (13%) of his/her regular straight time hourly rate for all straight time hours paid.
