PAYMENT FOR ABSENCES. NONPUBLIC SCHOOL STAFF ABSENCE Whenever a classroom teacher employed by CONTRACTOR is absent, CONTRACTOR shall provide an appropriately credentialed substitute teacher in the absent teacher’s classroom in accordance with California Education Code section 56061. CONTRACTOR shall provide to LEA documentation of substitute coverage pursuant to the LEA Procedures. Substitute teachers shall remain with their assigned class during all instructional time. XXX will not pay for instruction and/or services unless said instruction or service is provided by an appropriately credentialed substitute teacher. Whenever a related service provider is absent, CONTRACTOR shall provide a qualified (as defined in Section 7 of this agreement and as determined by XXX) substitute. XXX will not pay for services unless a qualified substitute is provided and/or CONTRACTOR provides documentation evidencing the provision of “make-up” services by a qualified service provider within thirty (30) calendar days from the date on which the services should have been provided unless otherwise agreed in student’s IEP.

Criteria for a billable day for payment purposes is one day of attendance as defined in California Education Code, sections 46010, 46010.3 and 46307. XXX shall not pay for services provided on days that a student’s attendance does not qualify for Average Daily Attendance (ADA) reimbursement under state law. Per Diem rates for students whose IEPs authorize less than a full instructional day may be adjusted on a pro rata basis in accordance with the actual proportion of the school day the student was served. XXX shall not be responsible for payment of DIS or related services for days on which a student’s attendance does not qualify for Average Daily Attendance (ADA) reimbursement under state law, nor shall student be eligible for make-up services. PAYMENT FOR ABSENCES. Employees shall accrue prorated each pay period equivalent to twelve (12) days annually. The maximum accrued but unused paid leave which may be carried over from one calendar year to the next will not exceed 1040 hours. With the approval of the employee's immediate supervisor, paid leave may be used as either sick leave or paid absence for personal business. The maximum amount of accrued but unused paid leave that can be used for paid absence for personal business in any one year is twenty-four (24) hours. Permission for Personal Business Absence must be obtained in advance and will be granted for business requiring the employee's personal presence (such as: closing on a real estate transaction, renewing a driver’s license or car registration, closing an estate, appointments with lawyers to consult about personal legal matters, delivery of major appliances and utility connections).

Regardless of how payment is issued or received for a TIPS Sale, Vendor is responsible for all reporting and TIPS Administration Fee payment requirements as stated herein.
