Pass Through Warranty. Except as provided in Article 12.3 below, no warranty, express or implied, shall extend to the Product, except for any pass-through warranty provisions for components procured by QUALCOMM from a third party that are assignable to Customer. The warranty extended to the Product is as provided below.
Pass Through Warranty. If Nuix provides any Hardware covered by a third party warranty, Nuix shall: (a) provide Licensee with a copy of each such warranty; and (b) if such warranty does not, by its terms, pass through to the Licensee, then to the extent permitted by the third party, assign to Licensee or otherwise cause the third party to grant to Licensee all warranties provided by such third party. These are Licensee’s exclusive warranty remedies with respect to such Hardware. No additional terms or warranties are offered.
Pass Through Warranty. Except as provided in Article 12.3 below, no warranty, express or implied, shall extend to the Product, except for any pass-through warranty provisions for components procured by QTI from a third party that are assignable to Customer. The warranty extended to the Product is as provided below.
Pass Through Warranty. Seller hereby assigns and passes through to Buyer, and Buyer shall have the benefit of, all rights it obtains under representations, warranties, and indemnities given by the third-party manufacturer, vendor, supplier, seller, or reseller in connection with any goods provided by Seller pursuant to this Agreement to the extent permitted by the applicable manufacturer, vendor, supplier, seller, or reseller. To the extent that such representations, warranties, and indemnities are not assignable by Seller, Seller agrees that Buyer may assert or enforce any right Seller may have to enforce such warranties, representations, and indemnities, or if such can only be enforced by Seller under its own name, upon written request by Xxxxx, Seller shall take all reasonable action requested by Buyer to enforce such warranties.
Pass Through Warranty. HBOC may assign to HBOC Customers to whom it has granted Sublicenses, its rights in, to and under the warranties and infringement indemnification set forth in this Article 11, and upon such assignment, such HBOC Customers shall have the benefit of the warranties and be subject to the limitations thereon. 11.1.4
Pass Through Warranty. Should the Contractor elect to not administer warranty claims on certain components and wish to transfer this responsibility to the sub-Suppliers, or to others, the Contractor shall request this waiver. Contractor shall state in writing that the CITY’s warranty reimbursements shall not be impacted. The Contractor also shall state in writing any exceptions and reimbursement including all costs incurred in transport of vehicles and/or components. At any time during the warranty period, the Contractor may request approval from the CITY to assign its warranty obligations to others, but only on a case-by-case basis approved in writing by the CITY. Otherwise, the Contractor shall be solely responsible for the administration of the warranty as specified. Warranty administration by others does not eliminate the warranty liability and responsibility of the Contractor.
Pass Through Warranty. Apptix does not manufacture any equipment. All equipment purchased under this Agreement is being provided by a third party. To the extent possible, Apptix will pass through any manufacturer’s warranties directly to Customer and will work with Customer to obtain any warranty services. The warranty for any hardware will be as specified in the Order Form. If the Order Form does not specify a warranty, the equipment is provided on an “AS IS” basis.
Pass Through Warranty. Seller makes no warranty to Buyer regarding the Product (other than a warranty of title) and Seller authorizes no third person or party to assume any warranty obligation or liability on Seller’s behalf. The only warranties applicable to the Product are those, if any, extended by the respective Manufacturer. The Manufacturer shall furnish to Buyer any and all applicable warranty documents. Seller hereby assigns to Buyer, without recourse, any applicable warranties extended to Seller. Such assignment shall constitute Seller’s sole obligation and Xxxxx’s sole exclusive remedy from Seller with regard to defective Product. SELLER SHALL HAVE NO OBLIGATION OR LIABILITY TO BUYER UNDER, AND HEREBY DISCLAIMS, ANY EXPRESS OR IMPLIED WARRANTY RELATED TO THE PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY AGAINST INFRINGEMENT OR ANY IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PRATICULAR PURPOSE.
Pass Through Warranty. WVS agrees to pass through to SILITEK all warranties it receives from its' manufacturers. WVS MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Pass Through Warranty. WVS agrees to pass through to Reseller and its customers all product warranties that WVS receives from the manufacturers of the WVS Modules. WVS further agrees to provide to Reseller in writing such warranties at any time at the request of Reseller and on or about January 1 of each year.
