Participant Requirements. You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.
Participant Requirements. Visitors must be physically and emotionally capable of participating in the Activities of OMOA, without being a danger to themselves or others. They must be participating voluntarily and not under the influence of drugs , alcohol or medications of any kind. Participants in the Treetop Quest and Spider Quest events must weigh no more than 250 pounds and have a flat footed reach of at least 4’5”. While on an obstacle course participants must wear a harness provided by OMOA, attached by a lanyard and carabineer to a continuous belay system. Parents of visitors 17 years of age or younger must remain reasonably available to the child while on the premises of the park. The Adult Visitor, or Parent, is responsible for determining his or her, or the Minor Visitor’s, suitability for the Activities and must seek assistance from the OMOA staff if suitability is in doubt. A visitor who fails to follow instructions and rules of the park or is otherwise considered by OMOA staff to be a danger to themselves or others may be removed from the Activity at any time at the sole discretion of staff and without the refund of fees paid. A misrepresentation of a participant’s weight, or of any other characteristic pertaining to safety, intentional or not, will cause the visitor to be a trespasser, and entitled only to the rights and privileges of a trespasser. In addition, in the event of such a misrepresentation, the Adult Visitor, or Parent, agrees to indemnify and protect OMOA from any claim of loss suffered or caused by him or her, and, if a Parent, suffered or caused by the Minor Visitor. Risks I, an Adult Visitor, am aware that participation in the Activities involves risks of harm to visitors and their property. These risks include slips and falls, uneven and sometimes difficult terrain, collisions with trees, platforms and other natural or man- made objects and other visitors, and the negligence of other visitors and OMOA staff, including the failure of staff to protect me, or the Minor Visitor, from unreasonable risks of harm. There will be times when visitors will not be supervised or even observed by OMOA staff members. The outdoor environment of the Activities will expose participants to the natural elements, including weather, falling timber, heat and cold, and possibly harmful plants, insects and animals, contact with which might cause injury, including allergic reactions. Participant Requirements. The KOHALA UTV ADVENTURE ("KUA") tour is designed for participants in reasonably good health. Due to the nature of the tour, we reserve the right to refuse participation to anyone. Participation in the tour carries inherent risks, both known and unknown, that may result in injury, illness or death. The tour occurs in an isolated environment and immediate medical attention may not be available. I acknowledge that this activity is purely voluntary, and I am participating with full knowledge of the risks inherent in such activity. We are not responsible for any of your personal property lost or damaged during tours or left in your vehicle. You must agree to and sign this Voluntary Participation Agreement & Liability Waiver (“VPA”) prior to participation in the tour. The following requirements will be enforced at all times: • Drivers must be age 21 or older and have a valid, official driver’s license. • All drivers must attend the safety briefing, complete the on-site practice course, and pass the practice course evaluation. • Only drivers who have passed the driver evaluation will be allowed to operate UTVs. • ALL safety equipment, including seatbelts, helmets, gloves and eye protection, must be worn AT ALL TIMES that UTV is in operation. • Closed-toe shoes are required. • Any participant exhibiting any cognitive or physical impairment that could negatively affect their ability to safely participate in this activity, will NOT be allowed on the tour. • Minimum age to participate is 8 years. • Youths younger than 18 years must have their parent or legal guardian review and sign the VPA. • Youths younger than 18 years must have an adult accompany them on the tour. • Excessive speed or deviating from the trail (speed and route as set by KUA's guides) will result in your removal from the tour (with no refund, either). NO EXCEPTIONS. • Drivers will be responsible for and pay for any and all intentional damage or theft of equipment supplied by KUA for the tour at the full replacement value of the equipment. • Drivers and all participants must remain seated with any seatbelts fastened while the UTV is in motion. • A driver who sees a passenger in the UTV acting in an unsafe manner shall stop the UTV as soon as can be safely done and notify a guide.
