Participant Requests for Distribution. The Participant may file a request with the Plan Administrator, for a distribution from the Account. Any such request shall be made in a manner acceptable to the Plan Administrator or, where applicable, the Master Custodial Administration Agreement Administrator and the Custodian. Where applicable, the Plan Administrator shall approve a request for distribution from the Account by the Participant in accordance with the applicable requirements of the Code and ERISA (as set forth in this Agreement), if applicable, and the provisions of any employee benefit plan sponsored by the Employer that controls the making of Contributions to the Account or the Plan Document, if any. If this Agreement is determined to constitute part of an “employee benefit plan” established or maintained by the Employer subject to Title I of ERISA, then the Employer is solely responsible for assuring that such distribution request complies with the requirements of Title I of ERISA.
