Parental Rights and Responsibilities. (Check one) ☐ Not applicable. ☐ (Select if one party has shared legal custody of the child OR if visitation is allowed.) The parties agree to the following with respect to each party’s care of the minor child: (Check all that apply) ☐ In the event of an emergency, serious illness or accident or other circumstance seriously affecting the minor child’s health and general welfare, the party who has physical possession or control of the minor child at the time will immediately notify the other party of such circumstances. The party who is notified shall have immediate access to the minor child and/or the right to telephonic communication with the minor child. ☐ In the event of a medical emergency, and only in such event, each party acknowledges that he/she has full confidence in the other's ability to make a unilateral decision for the minor child's welfare which otherwise would be a joint decision of the parties. ☐ Both parties shall be entitled to participate with and attend special activities in which the minor child is engaged, such as religious activities, school programs, sports events and other extracurricular activities and programs and important social events in which the minor child is or may be engaged or involved. ☐ Neither party shall, in any way, impede, obstruct nor interfere with the exercise by the other of his/her right of companionship with the minor child and neither of them, at any time, shall in any manner disparage or criticize the other party, nor allow any other to do so or in the presence of the minor child. Each party further agrees that he/she will in no way attempt to create a non-harmonious atmosphere for the minor child. ☐ Each party shall be entitled to complete and detailed information from all pediatricians, physicians, dentists, consultants or specialists attending the minor child for any reason whatsoever and to be furnished upon written request with copies of any reports given to other party. Parental Rights and Responsibilities. Each parent has the following rights and responsibilities unless they relinquish their parental rights: Right to access and obtain copies of the children's educational, medical, dental, religious, insurance, and other records or information. Right to attend educational conferences concerning the children. This right does not require any school to hold a separate conference with each parent. Right to reasonable access to the children by written, telephonic, and electronic means. Duty to inform the other parent as soon as reasonably possible of a serious accident or serious illness for which the children receive health care treatment. The parent shall provide to the other parent a description of the serious accident or serious illness, the time of the serious accident or serious illness, and the name and location of the treating health care provider. Duty to immediately inform the other parent of residential telephone numbers and address, and any changes to the same. Duty to keep the other parent informed of the name and address of the school the children attend. The court shall include, in an order establishing or modifying parental rights and responsibilities, the rights and duties listed in this section; however, the court may restrict or exclude any right or duty listed in this section if the order states the reason in support of the restriction or exclusion. The court shall consider any domestic violence protection orders relating to the parties when determining whether to restrict or exclude any right or duty listed in this section.
Parental Rights and Responsibilities. I understand that all rights and responsibilities for the care of any child resulting from the donation of my eggs will be the responsibility of the recipient(s). This includes any financial responsibilities and obligations associated with the care and upbringing of such a child. I am aware that there are or may be laws in the state of New York or other applicable states governing the legitimacy and legal status of children born following the use of donor eggs. By my signature below, I give up all rights to use or make decisions about my donated eggs following this procedure. Should a child be born as a result of my egg donation, by my signature(s) below, I give up any and all rights and claims I have or may be deemed to have to such a child. It is also possible that laws may be enacted in the future that would require the Center for Human Reproduction to reveal my identity to the recipient couple (woman) or resulting child. If such laws are enacted, the CHR might be required to adhere to those requirements. I understand that I might not be notified in such circumstances. Information on all cycles of Assisted Reproductive Technology treatment, along with data identifying recipients and women who undergo ART with their own eggs, is currently collected into a national database under the 1992 Fertility Clinic Success Rate and Certification Act. As part of this process, the Society for Assisted Reproductive Technology plans to begin to collect identifying information on all egg donors. As with recipient cycles and cycles for women using their own eggs, this information may be used to track outcomes. For this purpose, certain donor identifying information such as name, date of birth, and social security number will be reported to a Registry by SART member clinics for data aggregation. ASRM guidelines currently require permanent records be kept for all egg donation cycles. Efforts to collect this information are intended to respect donation confidentiality and not to disclose confidential identifying information to recipients, donors, or offspring. Control of such information in the future may, however, depend on applicable law. The Center for Human Reproduction does not offer legal advice on these matters and if I need or want legal advice I must consult an attorney with expertise in family law related to assisted reproductive technologies.
