Paragraph 62 the circumstances of the Claimant’s dismissal and the reasons for it are set out in section B.7 above. Xx X’Xxxxxxx does not recall using the phrase “with immediate effect”, but the precise wording is likely to be of limited importance given that it is agreed that the Claimant’s employment was terminated on that day. Xx X’Xxxxxxx spoke about the Claimant’s lateness and failure to attend work. He did not say that the substance of the Claimant’s protected disclosures had caused a problem for the Respondent’s staff, although he had previously told the Claimant that staff were “shell-shocked”, which they had been given the magnitude of the media coverage and the seriousness of the claims. There was a discussion between the Claimant and Xx X’Xxxxxxx, although it is correct that there was no formal process by which the Claimant was invited to respond to what he describes in this paragraph as “the allegations against him”. The Respondent did email a letter of dismissal to the Claimant shortly after the meeting.
