During drainage and filtration, the lid must be lowered in place on either the Winston or Xxxx filtration unit. Recommendation The Administration/Public Works Committee is recommending the selection of Waste Connections for a new license agreement for residential solid waste, recycling, and yard waste collection, including hauling, processing and disposal, which will be effective on August 1st. The new license agreement would be for two (2) years with three (3) optional one-year extensions. In addition, the Committee is recommending that our recycling program switch back to single-stream recycling effective with the start of the new agreement, likely the week of August 5th. Reasons for Recommendation • Waste Connections price quotation was competitive and their rate for basic service was lowest of the three (3) proposals received. • Waste Connections was able to demonstrate a record of excellent customer service based on their current contracts with St. Louis County and other municipalities. Therefore, Xxxx # 2463, which authorizes the Mayor to execute the license agreement with Waste Connections, has been prepared for the consideration of the City Council. P a g e. Purpose The Surface Mining Control and Reclamation Act of 1977 (SMCRA) requires that programs be developed and implemented to regulate surface coal mining and reclamation operations. Section 201 of SMCRA established the Office of Surface Mining Reclamation and Enforcement (OSMRE) within the US Department of the Interior to administer and implement SMCRA. Among its responsibilities, OSMRE is charged with reviewing and approving state and tribal programs for regulating surface coal mining and reclamation operations and making those investigations and inspections that are necessary to ensure compliance with SMCRA, as well as: promoting the achievement of program goals and objectives, ensuring adherence to Federal and state statutory and regulatory requirements and maintaining minimum nationwide mining and reclamation standards. SMCRA encourages states and tribes to assume the primary responsibility for regulating coal mining and reclamation activities (primacy). Once states or tribes are granted primacy, the role of achieving many of the purposes of SMCRA lies primarily with them. XXXXX's roles, when a state or tribe has primacy, are to: • Monitor the state or tribe and conduct inspections of surface coal mining and reclamation operations to ensure that the state or tribe is effectively implementing, administering, maintaining, and enforcing its state or tribal program, • Ensure the state or tribe maintains its capability to fulfill SMCRA responsibilities, • Assist the state or tribe in implementing its responsibilities, • Report on the evaluation of the state or tribal program, • Work with states and tribes to resolve, in a reasonable and timely manner, program and implementation issues identified through oversight, and • Pursue corrective actions provided by SMCRA, Federal rules, and OSMRE policy if states or tribes are not meeting program requirements. State primacy under the SMCRA provides individual states the opportunity to address local conditions and interests in developing individual programs. Consequently, state programs differ in both content and the manner in which they address SMCRA requirements. Evaluation of program effectiveness provides OSMRE the means to assure the individual state programs are appropriately addressing SMCRA requirements as they develop and administer their laws, regulations and policies.
