Overtime Distribution. The Parties recognize the following Sections for the purposes of this clause: Water/Wastewater, Roads, Winter Control, Fleet, Transit Fleet, Parks, and Environmental Services. There is a City Wide Geographic Area Section including such sections as line painting, metering, sign shop, traffic signals and facilities management. A Geographic Area is a designated work area, typically defined as a depot. The Employer is not limited to expanding or contracting Sections and can do so in accordance with its Employer rights under the Collective Bargaining Agreement. Overtime hours will first be made available as equitably as possible among the Permanent and Probationary Employees per Employee classification (including Part Time and Temporary Employees holding the classification on a limited posting) in the Section and Geographic Area where the work arises. Such overtime shall then be offered to other qualified Permanent and Probationary Employees in other classifications in the Section and the Geographic Area where the work arises. Such overtime will then be offered to qualified Temporary Employees in the Section and the Geographic Area where the work arises. Such overtime shall then be offered to other qualified Employees in other classifications in the Geographic Area where the work arises. Crews designated as City Wide are considered part of the Geographic Area Section containing their reporting depot, for purposes of this clause. In the case of Fleet, overtime is assigned per the above, but is offered in the Mechanical Shop where the work arises, and not by area section. In the event overtime is required in Winter Control, the above will apply, however overtime hours will first be offered to the Permanent and Probationary Winter Control Employee on the route where the work arises (including a Part Time or Temporary Employee holding a Limited Winter Control position on a Job Posting). Finally, overtime will be offered to any qualified Employee, on a rotation basis, after the equitable distribution above has been exhausted. The Employer will keep a list(s) in each Geographic Area which shall include the names of Permanent Full Time and Probationary Full Time Employees outside the classification but who are qualified to perform the work of the classification. Employees shall initially be placed on the list(s) in order of their seniority. Should an Employee decline the overtime opportunity, or should the Employee not be available at the time of a call, or should the Employee work the overtime opportunity, the Employee’s name shall be moved to the bottom of the list. The next overtime opportunity will be offered to the Employee whose name is now at the top of the list. If at any time an Employee is to be entered on the list, the Employee shall be placed on the list in accordance with the Employee’s seniority. Should the Employer exhaust the list of Permanent Full Time and Probationary Full Time Employees within the Geographic Area during a given call out, then such overtime will be offered to qualified Temporary Employees within the Geographic Area where the work arises, after which, the Employer may get the work done by whatever method the Employer deems efficient.

Overtime Distribution. The Parties recognize Overtime is to be distributed on a rotating basis as equally as possible, by position. An overtime system will be maintained to keep track of an individual’s eligibility and amount of overtime. A separate overtime list will be maintained for members of the Community Risk Reduction Division which will include the CRR Captain, Lieutenant and Public Education Officer. Where the City has advance notice of a need for overtime, the member at the top of the overtime list who meets qualifications for the position that was vacated has a right of first refusal. Should that member refuse the overtime, the City shall contact the next member on the list for the position vacated, and so forth until a person accepts the overtime assignment. Acceptance of an overtime assignment of ten (10) hours or more for shift employees (or three hours or more for non-shift employees in the Community Risk Reduction division) moves that person to the bottom of the overtime list. If the City receives notice prior to 10:00 PM that it will need to use overtime the following Sections for the purposes of this clause: Water/Wastewater, Roads, Winter Control, Fleet, Transit Fleet, Parks, and Environmental Services. If none of a call, or should the Employee work those employees voluntarily take the overtime opportunity, the Employeeleast senior employee of that position may be held for mandatory overtime until otherwise filled. In both situations as described above, should the list for a position be exhausted, the City shall then resort to the present promotional eligibility list, in which case overtime shall be offered first to the highest-ranking person on the list. Under this provision, members may be considered for positions in which they are qualified. In the event that there is no eligibility list, and/or all individuals have refused voluntarily to work overtime, the City shall call in the least senior employee in that position for mandatory overtime. In lieu of mandating a member to work, a member may voluntarily work down in a position in which they are qualified. Mandatory overtime shall rotate beginning with the least senior person in that position, then move to the second least senior, and so on. A separate line shall be kept for all overtime lists with the date of the mandatory overtime included. If department personnel are promoted, the overtime program will be adjusted accordingly, with the newly promoted employee going to the bottom of their new position’s name overtime list. In the event there is a need for “Emergency Overtime”, the above policy may be deviated from only so far as an employee, after being contacted, cannot report for duty within one hour, may be bypassed. Emergency Overtime shall be defined as being anytime a unit is placed out of service or will fall below minimum staffing levels due to illness, injury, or other emergency in which an employee must be relieved from duty. At all times the overtime list must be utilized to call for all overtime. The following process shall be followed when filling Emergency Overtime only: A text message / phone call will be sent out to all eligible members for the vacant position through Telestaff. The message will include (a) the position that needs to be filled, (b) the time frame for the overtime, (c) a number and e-mail address to respond to, and (d) a fifteen (15) minute time frame in which the member has to call the chief listed on the message with their interest for filling the overtime. The member should also email the chief listed on the message. Once the fifteen (15) minute time frame has been met, the chief officer filling the overtime will select the member that responded that is highest on the overtime list. When filling emergency overtime and a member has been mandated to work, the member ordered to fill the vacant position will only be moved to the bottom of the list. The next mandatory overtime opportunity will be offered to the Employee whose name is now at the top of the list. If at any time an Employee is to be entered on the list, the Employee shall be placed on the list in accordance with the Employee’s seniority. Should the Employer exhaust the list of Permanent Full Time and Probationary Full Time Employees within the Geographic Area when they have worked two (2) hours or more during a given call out, then such overtime will be offered to qualified Temporary Employees within the Geographic Area where the work arises, after which, the Employer may get the work done by whatever method the Employer deems efficientsingle ordered time frame.

Overtime Distribution. The Parties recognize the following Sections for the purposes of this clause: Water/Wastewater, Roads, Winter Control, Fleet, Transit Fleet, ParksA. Platoon Employees After all detailing has been accomplished, and Environmental Services.
