Overtime and Compensatory Time. Employees shall be on a 21 consecutive day work period for the purpose of computing overtime. Employees assigned to a Unit day rotation shall be regularly scheduled to work a tour of duty consisting of 24 consecutive hours and shall be off the following 48 hours consecutive hours. Regularly scheduled time worked in excess of 159 hours in a work period shall be compensated at a rate of one and one half (1.5) times the employee's hourly rate of pay. Any time worked other than regularly scheduled time shall be compensated at the rate of 2.15 times the employee's hourly rate of pay, if the employee takes the compensation as cash overtime compensation in the pay period corresponding to the time the compensation is earned. Employees assigned to a permanent forty (40) hour position, or temporary forty (40) hour assignment, shall be scheduled a standard work week of Monday through Friday, 0800-1600, or otherwise dictated by departmental needs. While assigned in this capacity, the employee shall be paid the standard pay rate to which they are entitled times one and four tenths (1.4). Overtime for forty (40) hour position shall be compensated at one and one half (1.5) times the aforementioned forty hour positions shall be compensated at one and one half (1.5) times the aforementioned forty hour pay rate, and will include any time accrued beyond forty hours in a calendar week. Once the maximum balance has been attained, authorized straight time and overtime hours will be paid at the applicable straight time or overtime rate. If the employee's balance falls below one hundred twenty (120) hours, the employee shall again accrue compensatory time off for authorized straight time and overtime hours worked until the employee's balance again reaches one hundred twenty (120) hours.
C. Accrued compensatory time off shall be carried over for use in the next fiscal year; however, as provided in b. above, accrued compensatory time off balances may not exceed one hundred twenty (120) hours.
D. Employees may not use more than one hundred twenty (120) hours of compensatory time off work per hour in any year period (January 1 – December 31).
E. The use of accrued compensatory time at a off shall be by mutual agreement between CCCERA and the employee. Compensatory time mutually convenient to off shall not be taken when the employee and would be replaced by another employee who would be eligible to receive, for time worked, either overtime payment or compensatory time accruals as provided for in this Section. This provision may be waived at the Fire Chief or designee. Time worked for the purpose discretion of this section, shall be defined as the sum of hours actually worked and hours of authorized leave used. C. Sick time, holiday, and vacation hours paid, but not worked, are not included in calculating overtime. Only actual hours worked in a given workday or workweek, and not hours scheduled, will apply in calculating overtime.
D. A non-exempt employee who performs authorized work in excess of regularly scheduled hours in his/her scheduled work week shall be compensated at the rate of 2.15 times the employee's hourly rate of pay, if the employee takes the compensation as cash overtime compensation in the pay period corresponding to the time the compensation is earned. Overtime and Compensatory Time. Employees 34.01 The Parties to this Agreement recognize that the performance of Employees’ duties may require the undertaking of job-related activities which fall outside normal working hours and which may take place either inside or outside of the National Capital Region. When such circumstances occur, the following shall apply:
34.02 FOR EMPLOYEES IN CATEGORIES 1 AND 2:
(a) All overtime shall be on a 21 consecutive day work period for approved in advance by the purpose of computing overtime. Employees assigned to a Unit day rotation Employer.

(e) Claims for overtime must be submitted in the month it was earned, or the month immediately following. Compensatory time off work per hour of accrued compensatory time at a time mutually convenient to the employee and the Fire Chief or designee. Time worked for the purpose of this section, shall be defined taken in the fiscal year during which it is accumulated, or in the fiscal period immediately following its accrual. It may not be carried over to any other fiscal period.
(f) Expenses related to dependant care incurred as a result of working overtime will be paid by the sum Employer based on submission of hours actually worked receipts by the Employee, with prior approval where feasible.
(g) Expenses incurred for parking or cab fare as a result of working overtime will be paid by the Employer based on submission of receipts.
(h) Expenses incurred for meals as a result of working overtime will be paid at the applicable rate based on the CAUT per diem rates as approved by CAUT Council.
(i) An Employee who has completed his/her regular day's work and hours of authorized leave used. Overtime shall be computed to has left the nearest fifteen (15) minutes. When an employee office and is called in for unscheduled work, overtime shall be for time actually worked, and in no case less than three (3) hours. An employee called in to work before the start of a employees regularly scheduled work shift is not entitled to the aforementioned three for eight (38) hour shifts; or
b) For all hours worked over ten (10) in any one workday for employees regularly scheduled for ten (10) hour minimum call in pay if the period of work abuts the shift. An employee held over from a regularly scheduled shift shifts.
c) Overtime will not be entitled to the three (3) hour call in minimum. An employee required to be held over in the morning, after 08:00, shall be paid for actual hours worked, calculated in fifteen (15) minute increments by rounding time worked to the nearest quarter hour in any one day. Employee time from one (1) to seven (7) minutes will be rounded, and thus not counted for hours worked. Employee time from eight (8) to fourteen (14) minutes will be rounded up and counted as a quarter of an hour worked.
d) A record of compensatory time off shall be maintained in the Human Resources Department. The compensatory time off hours available to each employee shall be reported out as frequently as, and on the same document reflecting the overtime hours as identified in this article.
e) An employee's request to use available compensatory time off shall follow the same procedure as the request for use of annual leave. No hours may be taken before they are earned, i.e., in anticipation of future overtime.
f) The Airport Director or his designee may approve or deny the use of compensatory time off, however the use will not be unreasonably denied.
g) Compensatory time off may be taken in whole hour increments, rather than only.
h) Compensatory time off may not be utilized during the three pay period in which it is accrued.
i) All time taken as compensatory time will be considered as hours worked for the purposes of computing benefits under this Agreement such as annual leave and PML. However, for the purpose of eligibility for overtime pay, overtime pay shall be calculated at one and one-half (31.50) times the hourly rate of the non-exempt employee for hours worked (excluding annual leave, PML, sick leave and compensatory time used) as follows:
1. For all hours over eight (8) in one workday for employees regularly scheduled for eight (8) hour shifts; or
2. For all hours worked over ten (10) in any one workday for employees regularly scheduled for ten (10) hour minimum set forth elsewhere shifts.
j) Compensatory time will be calculated in this contractfifteen (15) minute increments by rounding time worked to the nearest quarter hour in any one day. a) All requests to use CTO must be made in writing by completing a Request for Time Off form and submitting the form to the requestor’s supervisor.
b) The request for CTO shall be approved or denied by the supervisor as soon as possible after being submitted.
i. The request for CTO shall be approved on a first come, first served basis, provided the request does not result in a drop below the minimum staffing levels deemed appropriate by the applicable supervisor.
ii. In order to allow the use of CTO, the City shall not be required to pay another employee on an overtime compensationbasis in order to prevent a drop below minimum staffing levels.
iii. If the CTO request is denied, as authorized by this articlethe employee shall be given the option of scheduling an alternate date to use CTO within 60 calendar days of the date the request was to be effective. If a date is not available within the 60-day period, the employee may take such compensatory time off work as permitted by the Fire Chief, or designeechoose, at the rate of one and one-half (1.5) hours of time off work per hour of accrued compensatory time at a time mutually convenient his or her option, to the employee and the Fire Chief or designee. Overtime and Compensatory Time. SECTION 1. This article is intended to be used as the basis for computing overtime and shall not be construed as a guarantee of work per day or per week. Nothing contained herein shall be construed as preventing the Employer from restructuring the normal workday or workweek for the purpose of promoting efficiency or improving services; from establishing the work schedules of employees; or establishing part-time positions. If, based on weather emergencies or other acts of God, 0000 Xxxx Xxxxx Xxxx is closed, all employees required to work beyond closing time shall be paid straight compensatory time for all hours worked.

SECTION 3. The Employer shall have the option to pay compensatory time in lieu of cash for approved overtime hours worked, not to exceed twenty-four (24) hours per year. Employees shall receive approval from their supervisor prior to using earned compensatory time. Overtime and Compensatory Time. All Shift-Work Employees are eligible for overtime and compensatory time. Overtime shall be on a 21 consecutive day work period for the purpose of computing overtime. Employees assigned to a Unit day rotation shall be regularly scheduled to work a tour of duty consisting of 24 consecutive defined as hours and shall be off the following 48 hours consecutive hours. Regularly scheduled time worked in excess of 159 forty All authorized paid leave shall count as hours worked for purposes of calculating overtime. Authorized paid leave is any leave benefit as provided for in a work period shall the Agreement between the parties. Due to the nature of the schedule, employees will average sixteen (16) hours of overtime per week by working their normal scheduled shifts. This “guaranteed” overtime is built into the employee’s salary and will not be compensated eligible for compensatory time. Any hours worked outside of the employee’s normal schedule shall, at a rate of the Employer’s option, be paid at one and one one-half (1.51-1⁄2) times the employee's hourly rate of pay. Any ’s straight time worked other than regularly scheduled time shall be compensated at the rate of 2.15 times the employee's hourly rate of pay, if the employee takes the compensation as cash overtime compensation in the pay period corresponding to the time the compensation is earned. Employees assigned to a permanent forty (40) hour position, or temporary forty (40) hour assignment, shall be scheduled a standard work week of Monday through Friday, 0800-1600, or otherwise dictated by departmental needs. While assigned in this capacity, the employee shall be paid the standard pay rate to which they are entitled times one and four tenths (1.4). Overtime for forty (40) hour position shall be compensated at one and one half (1.5) times the aforementioned forty hour positions shall be compensated at one and one half (1.5) times the aforementioned forty hour pay rate, and will include any time accrued beyond forty hours in a calendar week. As used herein, hourly rate of pay shall include base hourly rate of pay, paramedic compensation, and educational incentive plan payment. In the event that an employee opts to take compensatory time in lieu of cash overtime compensation, as authorized by this article, the employee may take such or be given compensatory time off work as permitted by the Fire Chief, or designee, at the rate of one and one-half (1.51-1⁄2 ) hours for each hour worked. An employee may not have more than one hundred and twelve (112) hours of compensatory time off on the books at any time. All overtime work per hour outside of accrued compensatory time at an employee’s normal work schedule must be pre-authorized by the Chief and shall be work that is necessary or of an emergency nature. Employees shall not work overtime on their own or without the proper authorization of a time mutually convenient supervisor. For purposes of “proper authorization” as it pertains to responding to an emergency call prior to the employee and the Fire Chief or designee. Time worked start of a shift, standing authorization is assumed for the purpose of this section, shall be defined as the sum of hours actually worked and hours of authorized leave used. Overtime shall be computed to the nearest any response that will not incur more than fifteen (15) minutes. When an employee minutes of overtime, is called in for unscheduled work, overtime shall be for time actually workedmutually agreed to by both employees involved, and in no case less than the ambulance responds within three (3) hoursminutes. Additionally, all hourly employees who get called in to work outside of their normal hours of work will be paid for a regularly scheduled work shift is not entitled to minimum of two (2) hours at one and one-half (1-1/2) times their straight time hourly rate of pay or receive the aforementioned three applicable amount of compensatory time off. The Chief or designee may assign work to the employee for the entirety of the two (2) hour minimum. This paragraph does not apply to any mutually agreed- upon change in an employee’s work schedule. Any employee that is mandated to cover a scheduled vacancy with twelve (12) or less hours of notice, after 08:00or congruent to a tour/shift/work assignment they are currently working, shall be paid given a meal reimbursement up to $9.00 for actual hours workedbreakfast, in fifteen (15) minute increments$11.00 for lunch and $21.00 for dinner. For purposes of meal allowances, rather than the three (3) hour minimum set forth elsewhere in this contract. Employees held over/called in shall employee must be released immediately after equipment and personnel are returned to levels established by the “Read and Sign” Policy currently in effect or as may be revised from time to time. An employee who has been called in for unscheduled work, then is released from that work and later accepts another recall before the original three (3) unscheduled hours have expired, shall be paid for only a single three (3) hour overtime “call in” payment, or for actual overtime worked, whichever is more. In no event shall an employee become entitled to more than a single, three (3) hour minimum call-in payment for reporting scheduled to work during those three (3) for a portion of hours of unscheduled timebetween 08:00 and 11:00 to qualify for breakfast, even if the employee reports more than once during that time. At no time shall any employee “double dip” 11:01 and 15:00 for lunch or collect overtime twice 15:01 and 20:00 for the same period of time. Employees who are called-in for unscheduled work, are released from that work and later fail to respond to a subsequent call-in within the same three (3) hour period will relinquish their right to the guaranteed three (3) hour minimum call-in pay for their initial call-in during that period. Such employees will receive compensation only for their actual time worked during the three (3) hour period, at the overtime rate of compensation. Employees may accrue compensatory time in lieu of cash overtime payment in the manner specified in this Article. An employee’s compensatory time balance shall not exceed 240 hours. Compensatory time earned during holidays counts toward and is subject to this two hundred forty (240) hour cap. Accrued compensatory time may be cashed out, in full or in part, at the employee’s regular rate of pay at the employee’s request. Any employee who has accrued and unused compensatory time off at the time of his/her termination of employment shall be paid for such time at the rate of pay at termination. Upon the death of a firefighter of the Fire Division, said employee's estate shall receive a cash payment for all of said employee's accrued compensatory time, at said employee's current rate of paydinner.

D. Employees may not accrue a compensatory time- off balance that exceeds one hundred twenty (120) hours of (i.e., eighty [80] hours at time and one-half [1-1/2]). Once the maximum balance has been attained, authorized overtime hours will be paid at the overtime rate. If the employee's balance falls below one hundred twenty (120) hours, the employee shall again accrue compensatory time off work per hour for authorized overtime hours worked until the employee's balance again reaches one hundred twenty (120) hours.
E. Accrued compensatory time off shall be carried over for use in the next fiscal year; however, as provided in D. above, accrued compensatory time-off balances may not exceed one hundred twenty (120) hours.
F. The use of accrued compensatory time at a off shall be by mutual agreement between the Department Head or designee and the employee. In cases of emergency, employees will be allowed to use compensatory time mutually convenient with the approval of their supervisor to supplement any unpaid hours. Such approval shall not be denied unless employee has received prior notice. Compensatory time off shall not be taken when the employee and should be replaced by another employee who would be eligible to receive, for time worked, either overtime payment or compensatory time accruals as provided for in this Section. This provision may be waived at the Fire Chief discretion of the Department Head or designee. Time worked for the purpose of this section, shall be defined as the sum of hours actually worked and hours of authorized leave used. Overtime shall be computed to the nearest fifteen (15) minutes. .
G. When an employee is called in promotes, demotes or transfers from one classification eligible for unscheduled work, overtime shall be compensatory time off to another classification eligible for compensatory time actually worked, and in no case less than three (3) hours. An employee called in to work before the start of a regularly scheduled work shift is not entitled to the aforementioned three (3) hour minimum call in pay if the period of work abuts the shift. An employee held over from a regularly scheduled shift will not be entitled to the three (3) hour call in minimum. An employee required to be held over in the morning, after 08:00, shall be paid for actual hours worked, in fifteen (15) minute increments, rather than the three (3) hour minimum set forth elsewhere in this contract. Employees held over/called in shall be released immediately after equipment and personnel are returned to levels established by the “Read and Sign” Policy currently in effect or as may be revised from time to time. An employee who has been called in for unscheduled work, then is released from that work and later accepts another recall before the original three (3) unscheduled hours have expired, shall be paid for only a single three (3) hour overtime “call in” payment, or for actual overtime worked, whichever is more. H. Compensatory time earned during holidays counts toward accrual balances will be paid off when an employee moves from one department to another through promotion, demotion or transfer. Said payoff will be made in accordance with the provisions and salary of the class from which the employee is subject to this two hundred forty (240) hour cap. Accrued compensatory time may be cashed outpromoting, demoting or transferring as set forth in full or in part, at the employee’s regular rate of pay at the employee’s request. I. "Hours worked" do not include time for which persons are compensated, but do not actually work, except for holiday pay.

(2) Any overtime earned and chosen to be taken as compensatory time off may be allowed to accumulate to be taken as compensatory time off at a later date. Accumulated and unused compensatory time off will be paid off at the end of the second pay period in June. Said accumulation shall not exceed 240 60 hours at any one time except during the three month period prior to pay-off when maximum accumulation shall remain at 40 hours. Compensatory time earned during holidays counts toward and off is subject to this two hundred forty (240) hour capthe same approval process as used for granting vacation time.
