Oversight, Inspection and Testing. 31 3.6.1 ADOT will have the right at all times to conduct Oversight to: (a) comply with 32 FHWA or other applicable federal agency requirements; and (b) verify Developer’s 33 compliance with the Contract Documents, Project Management Plan, and any applicable 34 Law. ADOT may designate any Person or Persons, including its consultants and 35 independent auditors, to carry out any Oversight on ADOT’s behalf. ADOT will conduct 36 Oversight in accordance with Developer’s safety procedures and manuals, and in a 37 manner that does not unreasonably interfere with normal Project construction activity.

Oversight, Inspection and Testing. 3.4.1 KYTC will have the right at all times to conduct Oversight to: (a) comply with FHWA or other applicable federal agency requirements; and (b) verify DBT’s compliance with the Contract Documents, , and any applicable Law. KYTC may designate any Person or Persons, including its consultants and independent auditors, to carry out any Oversight on KYTC’s behalf. KYTC will conduct Oversight in accordance with DBT’s safety procedures and manuals, and in a manner that does not unreasonably interfere with normal Project construction activity. The foregoing shall not be construed to limit KYTC’s Oversight or prevent KYTC from conducting any Oversight that KYTC, in its sole discretion, deems necessary.
Oversight, Inspection and Testing. 5.4.1 LAWA shall have the right at all times to conduct Oversight as provided in this Section 5.4 and Part 2A, Section 4.4 (Quality Oversight) of the Technical Provisions. Such Oversight may include assessments regarding compliance with the Contract Documents, Project Management Plan, the O&M Management Plan and requirements of applicable Governmental Entities and applicable Law.   • Inspection and Testing Each Constructing Entity shall cause inspection and testing of the Interconnection Facilities that it constructs in accordance with the provisions of this section. The Construction Parties acknowledge and agree that inspection and testing of facilities may be undertaken as facilities are completed and need not await completion of all of the facilities that a Constructing Entity is building.

  • Inspection and Tests 3.8.1 The Procuring entity or its representative shall have the right to inspect and/or to test the goods to confirm their conformity to the Contract specifications. The Procuring entity shall notify the tenderer in writing in a timely manner, of the identity of any representatives retained for these purposes.

  • Inspections and Testing Each Interconnected Entity shall perform routine inspection and testing of its facilities and equipment in accordance with Good Utility Practice as may be necessary to ensure the continued interconnection of the Customer Facility with the Transmission System in a safe and reliable manner. Each Interconnected Entity shall have the right, upon advance written notice, to request reasonable additional testing of an Interconnected Entity’s facilities for good cause, as may be in accordance with Good Utility Practice.

The employee so designated shall suffer no loss of pay when this function is performed during the employee's regularly scheduled work hours.

  • Audit and Testing 4.1 The Contractor shall conduct tests of the processes and countermeasures contained in the Security Plan ("Security Tests") on an annual basis or as otherwise agreed by the Parties. The date, timing, content and conduct of such Security Tests shall be agreed in advance with the Authority.

  • Response/Compliance with Audit or Inspection Findings A. Grantee must act to ensure its and its Subcontractors’ compliance with all corrections necessary to address any finding of noncompliance with any law, regulation, audit requirement, or generally accepted accounting principle, or any other deficiency identified in any audit, review, or inspection of the Contract and the services and Deliverables provided. Any such correction will be at Grantee’s or its Subcontractor's sole expense. Whether Xxxxxxx's action corrects the noncompliance shall be solely the decision of the System Agency.

  • SCOPE OF INSPECTION The purpose of the inspection is to report the general condition of the home and identify and disclose major defects and deficiencies of the inspected systems and components which existed at the time of the inspection and which are evident to the inspector upon ordinary visual observation. Minor and cosmetic defects may be listed in the report for maintenance purposes but it is not the intent, nor will the inspection report identify and list all minor and cosmetic defects. The inspection is intended to evaluate systems and components of the primary premises. Included with the inspection is the evaluation of primary attached garages/carports/decks/porches/patios. The inspection does not include evaluation of detached garages/carports/patios/decks or other structures unless explicitly specified. The client is encouraged to accompany the inspector during the inspection. Client participation shall be at the client’s risk for personal injury or damage to person or property for any reason or from any cause. The inspection and report are performed and prepared for the sole, confidential and exclusive use and possession of the client(s). The inspection report is not transferable. Systems and components to be inspected include: exposed and visible foundations and structures, exteriors, roofing, plumbing, electrical, attic, interiors, bathrooms and kitchen, basement and crawlspaces, heating and central air conditioning, and garage or carport. LIMITS OF THE INSPECTION The inspection is limited to the readily accessible and visible systems, equipment and components of the home. The inspector will not dismantle and/or move equipment, systems, furniture, appliances, floor coverings, finished or fastened surfaces or components, personal property or other items to conduct this inspection or otherwise to expose concealed or inaccessible conditions. The inspection will not include destructive testing of any kind.
