Overholding Tenant. 1.5. If the Tenant continues to occupy the Premises after the termination of this Agreement, with the consent of the Landlord and without any further written agreement, the Tenant shall be a yearly tenant.
Overholding Tenant. If at the expiration of the Term by elapse of time the Tenant shall hold over without the written consent of the Landlord for any reason the tenancy of the Tenant thereafter shall be from month to month and shall, in the absence of written agreement to the contrary, be at a monthly Base Rent of twenty thousand dollars ($20,000.00) and subject to all covenants, obligations and agreements provided for in this Lease, except as to duration and rights of renewal, if any.
Overholding Tenant. If the tenant stays in the premises without the landlord’s approval, the tenant becomes an overholding tenant. The landlord can apply to the courts or RTDRS for an Order for Possession of the property from an overholding tenant. IMPLIED PERIODIC TENANCY The RTA states an implied periodic tenancy is a combination of a fixed term tenancy and a periodic tenancy. If the tenant stays in the premises after the end of the fixed term period with the implied consent of the landlord, the tenancy continues as a periodic tenancy. If the fixed term was for one month or more, the periodic tenancy becomes a monthly tenancy. If the fixed term was for less than one month, the periodic tenancy becomes a weekly tenancy. The rules of periodic tenancies then apply to this tenancy. If the tenant or the landlord wants to terminate the agreement, they will have to give the proper notice. PERIODIC TENANCY A periodic tenancy renews or continues weekly, monthly or yearly without notice. The termination and rent increase provisions contained in the RTA apply to the tenancy.
Overholding Tenant. If the Tenant remains in possession of the Premises after the end of the Term and without the execution and delivery of a new lease, there will be no tacit renewal or extension of this Lease or the Term hereby granted, despite any statutory provision or legal presumption to the contrary, and the Tenant will be deemed to be occupying the Premises as a tenant from month to month, at a monthly rent payable in advance on the first day of each month equal to the sum of:

Overholding Tenant. If the Tenant overholds, the tenancy will be from month to month at a rent equal to one and one half (1.5) times the Rent payable in respect of the month immediately preceding the expiration of this Lease, payable in advance on the first (1st) day of each month and shall be subject to all other terms of this Lease, but a tenancy from year to year will not be created by implication of law. Monthly rent shall be prorated on a daily basis for each day that the Tenant remains in possession of the Leased Premises.
Overholding Tenant. If without Landlord's written consent, Tenant remains in possession of the Premises after the expiration or other termination of the Term, Tenant shall be deemed to be occupying the Premises at a charge equal to two times the monthly Rent determined in accordance with Article 4.00. Such may be terminated by Landlord at any time upon demand, and may be terminated by Tenant by delivery of at least ninety (90) days advance notice of termination.
Overholding Tenant. In the event the Tenant remains in possession of the Leased Premises after the end of the Term and without the execution and delivery of a new lease, there shall be no tacit renewal of this Lease and of the Term hereby granted and the Tenant shall be deemed to be occupying the Leased Premises as a tenant from month-to-month, subject to a 30-day notice of termination by the Landlord, at a monthly rent payable in advance on the first day of each month equal to the sum of (i) the monthly Minimum Rental payable during the last month of the Term of the Lease and (ii) the Additional Rental herein specified; and otherwise upon the same terms, conditions and provisions as are set forth in this Lease insofar as the same are applicable to a month-to-month tenancy. Overholding Tenant. 19.1. If Diamond shall continue to occupy the Sani-Dump Site with the written consent of Spruce Grove after the expiration of the Term or the Extension Period (if applicable), but without any further agreement, then Diamond shall be deemed to be a tenant from month to month at a basic rental of One Dollar ($1.00) per month payable in advance not later than the first day of each month during the period of overholding, and In such case as the provisions of this Agreement insofar as they are applicable to monthly tenancies shall continue to apply, including but not limited to the right of either party to terminate this Agreement upon giving not less than (1) one month’s written notice to the other party in accordance with this Agreement.
