Our Warranty. We warrant that the Platform will materially conform to the specifications set forth in the applicable Order Form and Documentation. We further warrant that We will perform Professional Services in a professional and workmanlike manner in accordance with the Order Form. You must notify Us of a claim under this warranty within 30 days of the date on which the condition giving rise to the claim first appears. To the extent permitted by law, Your sole and exclusive remedy arising out of or in connection with a breach of warranty is limited to correction of the Platform or re-performance of the Professional Service, as applicable, or if correction or re-performance is not commercially reasonable, termination of the applicable Order Form and a refund of any prepaid unused fees for the applicable Platform or Professional Services. This warranty shall not apply if the error was caused by misuse, unauthorized modifications, Customer Data or third party-hardware, software or services.
Our Warranty. (a) Subject to limitations and exclusions set out in paragraph 10, CEVA warrants that it shall deliver the vehicle to the location identified in the Quotation or Booking Form or any other location agreed between us and you, in the same condition that the vehicle was delivered to CEVA. However, you agree that if CEVA is required to retain possession of the vehicle because you have been unable to accept physical delivery, CEVA will not be liable for the condition of the vehicle if that vehicle has not been collected from CEVA within thirty (30) days of delivery.

We represent and warrant on a continuing basis that we have the requisite skill, judgement, ability, capacity and experience necessary to perform the Services under this Agreement, including carrying out works (where applicable) in accordance with the Electrical (Safety) Regulations 2010 and the Australian/New Zealand Wiring Rules.

THIS WARRANTY IS OUR ONLY WARRANTY CONCERNING THE SERVICES AND ANY DELIVERABLE, AND IS MADE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE, ALL OF WHICH ARE HEREBY DISCLAIMED.

To the extent permitted by law, your sole and exclusive remedy arising out of or in connection with a breach of warranty is limited to correction of the non-conforming Subscription Services or re-performance of the Professional Services, as applicable, or if correction or re-performance is not commercially reasonable, termination of the applicable Service Order and a refund of any prepaid unused fees for the applicable Subscription Services or Professional Services. Furthermore, we warrant that we shall comply with all laws and regulations, including without limitation those applicable to data security and privacy, as applicable to us in providing the Services.
