Other Litigation Expenses. Other Litigation Expenses shall mean those expenses which are not part of the contract with the CONTRACTOR, expert witness services, language translators, laboratory analysis, and other forensic services. It is anticipated that payment for such expenses will be applied for in the appropriate courts by motion and granted out of separate funds reserved for that purpose. Payment for mitigation specialists in Capital cases is included in this category.

Other Litigation Expenses. “Other Litigation Expenses” shall mean those expenses which are not part of the contract with the Contractor, including investigations, expert witness services, language translators, laboratory analysis, and other forensic services. It is anticipated that payment for such expenses will be provided as set forth in the County’s Model Plan for the Provision of Indigent Defense Services.

Lead Counsel will apply to the Court for a collective award of attorneys’ fees to Plaintiffs’ Counsel to be paid solely from (and out of) the Settlement Fund.
