Other Goals. The Other Goals will be one or more quantitative and/or qualitative goals established by the Committee, with the Other Goals providing an award opportunity with an aggregate target payout level equal to 25% of the Target Performance Bonus (specifying the payouts for each Other Goal). Other Goals will be specified actions or results relating to the Company as a whole, specific business lines of the Company, Xx. Xxxxxxxx individually, or other designated items that the Committee regards as having potential to significantly advance the business success of the Company (for example, expanding business lines or product offerings, improving management processes, identifying and implementing acquisitions or joint ventures, etc.). The Committee may, in its discretion, specify a payout level below the target level corresponding to achievement at or above a specified threshold level of performance (but below the target levels of performance) with respect to an Other Goal. In the event that the level of achievement of an Other Goal exceeds 100% of the target (or equals or exceeds any specified threshold), the Committee retains discretion to provide for a higher level of payout than pre-specified by the Committee for that Other Goal, provided that such above-target payouts will not exceed 37.5% of the Target Performance Bonus. The Committee will retain discretion to adjust the manner of determination of the Other Goals or to adjust upward or downward the payout relating to Other Goals, including but not limited to cases in which performance is less than a designated threshold level or target level of one or more Other Goals.

Xxxxxxx individually, or other designated items that the Committee regards as having potential to significantly advance the business success of the Company (for example, expanding business lines or product offerings, improving management processes, identifying and implementing acquisitions or joint ventures, etc.). The Committee may specify payout levels above the level of 25% of the Target Performance Bonus corresponding to above-target performance with respect to Other Goals, either as a term specified when the Other Goals are established or otherwise in its discretion, provided that such above-target payouts will not exceed 37.5% of the Target Performance Bonus. In the event that performance is less than the threshold level or target level of one or more Other Goals, if the “gate-keeper” goal has been achieved (as set forth below), the Committee will retain discretion to determine the level of payout, if any, of the Target Performance Goal, subject to the applicable limits as set forth below.
Other Goals. Beyond achieving the stated emissions reduction targets and measurable savings, the partnership is intended to contribute more broadly to the fulfillment of Berlin’s climate goals. In this context, activities carried out by the State of Berlin or third parties can be jointly pursued or supported to the extent that the partners are able. These activities might, for example, focus on awareness raising, changing lifestyles and consumption habits, and adapting to the consequences of climate change, including through the Berlin climate impact monitoring system.

Other Goals. The Student Intern Agrees To: • comply with the organization’s policies and procedures; • follow protocols for dress, appropriate behavior, correspondence and work space maintenance; • complete any necessary training prior to the internship; • attend the internship site during scheduled work dates/times, notifying supervisor of absence or late arrival with sufficient notice prior to start time; • meet school requirements to receive academic credit (if applicable); • perform responsibilities in a timely and satisfactory manner; • inform intern supervisor or senior management of any problems or concerns. The Supervisor And Organization Agree To: • comply with the U.S. Department of Labor policies on paid/unpaid internships; • adhere to all state and federal child labor laws; • provide a safe work zone; • conduct appropriate training for the student prior to the internship; • assign an intern mentor for the student; • establish a set work schedule and lesson plan for the student; • provide the student with periodic feedback and constructive criticism; • ensure the student’s learning goals are addressed; • meet school requirements for student to receive academic credit (if applicable); and • compensate the student according to agreed-upon rate.   • Performance Goals A. The Trust and State Street have developed mutually acceptable performance goals dated March 1, 2011 , and as may be amended from time to time, regarding the manner in which they expect to deliver and receive the services under this Agreement (hereinafter referred to as “Service Level Agreement”). The parties agree that such Service Level Agreement reflects performance goals and any failure to perform in accordance with the provisions thereof shall not be considered a breach of contract that gives rise to contractual or other remedies. It is the intention of the parties that the sole remedy for failure to perform in accordance with the provisions of the Service Level Agreement, or any dispute relating to performance goals set forth in the Service Level Agreement, will be a meeting of the parties to resolve the failure pursuant to the consultation procedure described in Sections V. B. and V.C. below. Notwithstanding the foregoing, the parties hereby acknowledge that any party’s failure (or lack thereof) to meet the provisions of the Service Level Agreement, while not in and of itself a breach of contract giving rise to contractual or other remedies, may factor into the Trust’s reasonably determined belief regarding the standard of care exercised by State Street hereunder.
