Organic Waste Processing Facility. Contractor must deliver all Organic Waste Collected 713 pursuant to this Agreement to a fully permitted Organic Waste Processing Facility that has been selected 714 by the City. All expenses related to Organic Waste processing will be the sole responsibility of Contractor. 715 Failure to comply with this provision constitutes default under this Agreement. City has the right to designate 716 the Organic Waste Processing Facility and Contractor’s Compensation shall be adjusted to reflect any 717 increase or decrease in Contractor’s costs resulting from the City’s exercise of flow control rights. Contractor 718 must ensure that the Organic Waste Collected pursuant to this Agreement is not delivered to a Disposal 719 Facility.
Organic Waste Processing Facility. All Organic Waste collected as a result of performing Commercial Collection Services shall be delivered to an Organic Waste Processing Facility approved by the District. Failure to comply with this provision shall result in the levy of an administrative charge as specified in this Agreement and may result in the Company being in default under this Agreement. All expenses related to Organic Waste processing and marketing will be the sole responsibility of Company.
Organic Waste Processing Facility. “Organic Waste Processing Facility” means a State permitted commercial Solid Waste facility which accepts and processes Organic Materials.
Organic Waste Processing Facility. Any facility designed, operated and legally permitted for the purpose of receiving and processing of Organic Waste.
Organic Waste Processing Facility. CONTRACTOR shall deliver all 875 collected Organic Waste to a legally permitted Organic Waste Processing Facility. Organic 876 Waste shall not stay on site at designated Transfer Facility for a duration longer than allowed by 877 current operating permits prior to transferring to the Organic Waste Processing Facility. Failure 878 to comply with this provision may result in the levy of liquidated damages as specified in Article 879 20 of this Agreement and may result in CONTRACTOR being in default under this Agreement.
Organic Waste Processing Facility. CONTRACTOR shall transport all Organic Waste collected as a result of performing Organic Waste Collection Services to a properly permitted Organic Waste Processing Facility as has been selected by CONTRACTOR and noticed to CITY or as otherwise provided in Article 41 hereof. Failure to comply with this provision shall result in the levy of liquidated damages as specified in Article 20 of this Agreement and may result in CONTRACTOR being in default under this Agreement. Notwithstanding the provisions of this Section, the CONTRACTOR may deliver Organic Waste 1498 1499 1500 1501 1502 1503 1504 1505 1506 1507 1508 1509 1510 1511 1512 1513 1514 1515 to the Disposal Facility for use as alternate daily cover until such time as such deposits shall contravene applicable law or regulation.
Organic Waste Processing Facility. CONTRACTOR shall transport all Organic Waste collected as a result of performing MFD Organic Waste Collection Services to a properly permitted Organic Waste Processing Facility as has been selected by CONTRACTOR and noticed to CITY or as otherwise provided in Article 41 hereof. Failure to comply with this provision shall result in the levy of liquidated damages as specified in Article 19 of this Agreement and may result in the CONTRACTOR being in default under this Agreement. Notwithstanding the provisions of this Section, the CONTRACTOR may deliver Organic Waste to the Disposal Facility for use as alternate daily cover until such time as such deposits shall contravene applicable law.
Organic Waste Processing Facility. CONTRACTOR shall transport all Organic Waste collected as a result of performing Commercial Organic Waste Collection Services to a properly permitted Organic Waste Processing Facility as has been selected by CONTRACTOR and noticed to CITY or as provided in Article 41 hereof. Failure to comply with this provision shall result in the levy of liquidated damages as specified in Article 20 of this Agreement and may result in the CONTRACTOR being in default under this Agreement.
Organic Waste Processing Facility. Company shall deliver all collected Organic Waste to a fully permitted Organic Waste Processing Facility or a fully permitted Organic Waste transfer station. All expenses related to Organic Waste processing and marketing will be the sole responsibility of Company.
Organic Waste Processing Facility. Beginning on the Service Commencement Date, Contractor shall timely deliver all collected Organic Waste to a fully permitted Organic Waste Processing Facility as designated by Contractor, in accordance with applicable law. In the event the facility is closed on a Work Day, the Contractor shall transport and deliver the Organic Waste to such other legally permitted facility. Contractor shall ensure that all Organic Waste collected pursuant to this Agreement, except residue resulting from processing, is delivered to an Organic Waste Processing Facility that operates in compliance with diversion and recycling legislation and regulations. Failure to comply with this provision is a material breach of this Agreement may result in the imposition of liquidated damages as specified in Section 30.5 of this Agreement and may subject Contractor to the remedies provided in Section 28 and Section 30.
