Order supervision. Is the requirement of the Schedule to § 9 BDSG for order supervision met? Are all the requirements of § 11 BDSG (ADV) recorded in writing (control rights of the contracting authority, rights of the persons affected, instructions of the contractor, sub-contract, obligations of the employees as per § 5 BDSG, technical and organizational measures)? Are the contractor’s employees engaged with the service provided announced namely to the contracting authority? Will the contracting authority be informed in case of personnel changes? Are confidentiality obligations regulated between the companies? Is a power to direct regarding the processing of personal data recorded in writing in the contract? Is it contractually specified that all personnel data will be used only within the direction of the ADV and passing on to third parties without written approval from the contracting authority is excluded? Notes / Comments: It must be ensured that the rules of the ADV (§ 11 BDSG) are observed. - Inspections by the contracting authority: The contracting authority will conduct regular checks regarding compliance with the contractual agreement on the contractor’s site. - Rights of the persons affected: The rights of the person affected shall be claimed towards the contracting authority. It has to be agreed upon that in case person affected assert their rights directly towards the Contractor, he has to inform the contracting authority immediately. - Data confidentiality: For the person employed by the Contractor the data confidentiality as per § 5 BDSG applies, provided they act in the collection, processing and use of personal data in a stage of data processing (storage, transfer, alteration, deletion or blocking) or in the use. In particular, the legal obligation of careful selection of the contractor requires it to govern this issue in the contract as well as complementary rules regarding the non-disclosure of business secrets.
