ORDER MODIFICATIONS. If Buyer requests to modify or cancel its purchase order after formation of a Contract, Buyer shall compensate Tennant for its reasonable expenditures made in reliance on Buyer’s purchase order prior to its receipt of the modification request, including, without limitation, expenditures to design, procure, or manufacture non-standard components or configurations for machines, accessories, parts or consumables. Tennant shall use commercially reasonable efforts to mitigate such expenditures after its receipt of the modification request. All material changes and those affecting fit, form, or function must be mutually agreed upon in writing. Buyer is responsible for all reasonable costs and actual damages to Tennant related to delays caused by Xxxxx.
ORDER MODIFICATIONS. 4.1 You agree to not modify dates and places initially agreed for delivery and return. In any case of modification, you must inform us immediately and wait for our possible acceptance before proceeding in any other manner than that agreed, and we will apply the following provisions, depending on the modification requested: - If you cancel the order before the shipment, we will apply the penalty provided in Art. 7.1 E for “modification of the order” and we will refund 90% of the amount relating to the “rental” and to any “insurance”, and 100% of the “shipping” fee. - If you cancel the order after the shipment, or if you return the device in advance with respect to the date agreed, we will apply the penalty provided in Art. 7.1 E for “modification of the order” and we will refund 70% of the amount relating to the “rental” and to any “insurance”, starting from the day after the date in which the device is collected by the courier for the return; - If you intend to extend your rental period, we will apply the penalty provided in Art. 7.1 E for “modification of the order” and we will send you a payment request for the additional “rental” days and for any “insurance”, applying the rental fees in force on the date of the extension, as if it were a new order. In this case, you are required to make the payment by the deadline we will indicate, otherwise, if the deadline won’t be respected, the extension request will be considered cancelled and you will have to return the device in accordance with the terms originally agreed; - If you modify the delivery and/or the return place, we will verify if the modification is possible and if so, we will apply the penalty provided in Art. 7.1 E for “modification of the order” and we will charge/credit the possible different delivery and/or return cost with respect to the options initially established. If the modification causes delays in the delivery date initially provided, no refund is provided for the possible lost rental days.

Alfa Xxxxxxx shall use commercially reasonable efforts to mitigate such expenditures after its receipt of the modification request. All material changes and those affecting fit, form, or function must be mutually agreed upon in writing. Buyer is responsible for all reasonable costs and actual damages to Alfa Xxxxxxx related to delays caused by Buyer.
ORDER MODIFICATIONS. Affymetrix may increase, decrease, cancel, re-schedule or otherwise modify any order accepted by Roche only with the written approval of Roche. Affymetrix acknowledges that Roche may impose a reasonable and customary charge for any modification of an order that it approves.
ORDER MODIFICATIONS. If Buyer requests to modify or cancel its purchase order after formation of a Contract, Buyer purpose and all other remedies. These are the only remedies of Buyer for any breach of warranty or any other claim.
ORDER MODIFICATIONS. LSR change requests require a supplemental LSR. A supplemental LSR will be used for a due date change as well as a change or correction to information provided on the original LSR.
ORDER MODIFICATIONS. Users and Providers are responsible for any order modifications they agree to make via the Fresh Homemade Tortillas Platform or direct Fresh Homemade Tortillas customer service to make on their behalf ("Order Modifications"), and agree to pay any additional amounts, fees, or taxes associated with any Order Modification.
ORDER MODIFICATIONS. Any order modification or cancellation requested by the customer can only be taken into consideration if it is received in writing by HEXONYS before the start of the production process and considering specific supplies.
ORDER MODIFICATIONS. Customer-requested changes to the order composition, schedule or handling must be made in writing, by email only, and are subject to Xxxxxxx’x written approval. Where a proposed change may result in shipment delays or increased production costs, Xxxxxxx may condition its approval upon adjustments in order pricing, scheduling, payment terms or other affected terms and conditions. Xxxxxxx reserves the right to reject any change that it deems incompatible with Xxxxxxx’x production capabilities.
