OPTIONAL SOFTWARE FEATURES. Software provided to Customer under this Agreement may contain optional features which are separately licensed and priced. Customer understands and agrees that such optional features will not be activated without written authorization from Seller and Customer's payment of the appropriate license fees. If, in spite of Customer's best efforts to comply with this restriction, such features are activated, Customer agrees to so notify Seller within five (5) business days from the date of Customer's knowledge that such features were activated and to pay Seller the current license fees charged by Seller for the activated features, as well as the reasonable cost of money for the period in which such features were activated.

OPTIONAL SOFTWARE FEATURES. Software licensed by Supplier to MetroPCS under this Agreement may contain optional features that are separately licensed and priced. Optional features will not be activated by MetroPCS without authorization from Supplier and MetroPCS’ payment of the applicable license fees, if any. If, in spite of MetroPCS’ commercially reasonable efforts to comply with the foregoing restriction, such features are activated, MetroPCS promptly shall notify Supplier that such features were activated. If Supplier identifies activation of any such features, Supplier promptly shall notify MetroPCS of the activation of such features. Upon any such notice by one party to the other party, at its option, MetroPCS shall either discontinue its use of such features or, if otherwise a chargeable item to MetroPCS, pay to Supplier *** for the activated features (subject to ***).

Ordering Company agrees that such optional features will not be activated without written authorization from Supplier and Ordering Company's payment of the appropriate license fees. If, in spite of Ordering Company's best effort to comply with this restriction, such features are activated and used by Ordering Company, Ordering Company agrees to so notify Supplier promptly and to pay Supplier the license fees for the activated features, as well as the reasonable cost of money for the period in which such features were activated.

If the Software package IS NOT LISTED in Schedule A, Part II and DOES NOT CONTAIN an "L" in the "License Status" column, such Software packages IS NOT LICENSED to the Buyer as part of the Standard Software load for the DMS-500 Initial System.
