Common use of Option to Extend Lease Term Clause in Contracts

Option to Extend Lease Term. Landlord and Tenant acknowledge and agree that the Extended Term provided herein shall be deemed to represent the first of Tenant’s two (2) options to extend the Lease Term as provided in Section 2.2 of the Original Lease, and that effective as of the date of this Second Amendment, Tenant shall continue to have only one (1) option to extend the Lease Term for a period of three (3) years in accordance with, and pursuant to the terms of, Section 2.2 of the Original Lease.

Option to Extend Lease Term. Landlord and Tenant acknowledge and agree that the Extended Term provided herein shall be deemed not to represent the first any of Tenant’s two 's three (23) options to extend the Lease Term as provided in Section 2.2 of the Original Lease. Accordingly, Landlord and Tenant acknowledge and agree that effective as of the date of this Second Amendment, Tenant shall continue to have only one the three (13) option options to extend the Lease Term Term, each for a period of three five (35) years years, in accordance with, and pursuant to the terms of, Section 2.2 of the Original Lease.2.2

Option to Extend Lease Term. Landlord and Tenant acknowledge and agree that notwithstanding the extension of the Lease Term for the Third Extended Term provided herein Term, Tenant shall be deemed continue to represent the first of Tenant’s two have one (21) options option to further extend the Lease Term as provided pursuant to the same terms set forth in Section 2.2 of the Original Lease, and provided that effective as the Option Term shall be for a period of the date of this Second Amendment, Tenant shall continue to have only one (1) option year (as opposed to extend the Lease Term for a period of three five (35) years as set forth in accordance with, and pursuant to the terms of, Section 2.2 3.2 of the Original LeaseThird Amendment).

Landlord and Tenant acknowledge and agree that the Extended Term provided herein shall not be deemed to represent the first of Tenant’s two (2) options 's option to extend the Lease Term as provided in Section 2.2 of the Original Lease, and that effective as of the date of this Second Amendment, accordingly Tenant shall continue to have only one (1) option to extend the Lease Term for a period of three (3) years in accordance with, and pursuant to the terms of, Section 2.2 of the Original Lease; provided that effective as of the date of this Second Amendment such option to extend the Lease Term shall be for five (5) years (as opposed to three (3) years as presently set forth in the Lease).
