Opportunity to Rescind. You may cancel this Release as to the release of claims arising under the Minnesota Human Rights Act within 15 days after signing it and as to the release of claims arising under the ADEA within 7 days of signing it. The Release will not become effective or enforceable until both rescission periods have passed. If you decide to rescind the Release you must mail or hand deliver the notice of rescission to: Chief Executive Officer, Tile Shop Holdings, Inc., 00000 Xxxxxxx Xxxxxxx, Plymouth, Minnesota 55441. If you mail the notice of rescission, the notice must be postmarked within the 15 or 7 day period, as applicable, and must be sent via certified mail, return receipt requested, as addressed above. If you exercise the right to rescind under this Section 3, all other provisions of the Release will immediately be null and void and you will not receive severance pay as described in the Employment Agreement or otherwise.

If Executive decides to rescind his release of claims under the ADEA contained in this Exhibit A and mails his notice of rescission, Executive understands that the notice of rescission must be postmarked within the seven (7) day period and be addressed to Xxxxxx X. If Executive rescinds his release of claims under the ADEA, only those claims will be rescinded and Executive will not receive the portion of the Settlement Payment described in Paragraph 3B of the Agreement. Any rights and obligations Executive has under the remainder of the Agreement will remain in effect.
Opportunity to Rescind. Tondera may cancel this Agreement for any reason within fifteen (15) xxxx xfter signing it. If he decides to do so and to mail his notice of cancellation, Tondera understands that it must be postmarked within the fifteen (10) xxx period and addressed to Mack Traynor at HE1 and sent by certified mail, return receipt requexxxx.

If mailed by post, it must be sent by certified mail, return receipt requested.

If exercises his/her right to rescind under this paragraph, all other provisions of this Agreement shall immediately be null and void.

If Geadelmann exercises the right to rescind under this Section 4, all other provisions of the Amendment and Release shall immediately be null and void and Geadelmann will not receive consideration as described in this Amendment and Release.

If I decide to cancel this Release Addendum and mail my notice of cancellation, I understand that it must be postmarked within the fifteen (15) day period and addressed to the Office of General Counsel, University of St. Xxxxxx, 0000 Xxxxxx Xxxxxx, XXX 000, Xx. Xxxx, MN 55105, either by hand or postmarked by certified mail, return receipt requested, within the fifteen (15) day period. This Release Addendum shall not become effective or enforceable until the revocation periods set forth above have passed. I understand that if I cancel this Release Addendum, I will not receive the Separation Payment granted by the Agreement but that the Agreement shall otherwise remain in full force and effect.

If Employee does not timely sign or decides to cancel this Agreement, the Agreement shall be null and void, and Employee will not be entitled to any of the Retirement Benefits.
