Opinions of Probable Cost. Opinions, if any, of probable cost, construction cost, financial evaluations, feasibility studies, economic analyses of alternate solutions and utilitarian considerations of operations and maintenance costs, collectively referred to as “Cost Estimates,” provided for are made or to be made on the basis of the Consultant's experience and qualifications and represent the Consultant's best judgment as an experienced and qualified professional design firm. The parties acknowledge, however, that the Consultant does not have control over the cost of labor, material, equipment or services furnished by others or over market conditions or contractor's methods of determining their prices, and any evaluation of any facility to be constructed or acquired, or work to be performed must, of necessity, be viewed as simply preliminary. Accordingly, the Consultant and Client agree that the proposals, bids or actual costs may vary from opinions, evaluations or studies submitted by the Consultant and that Consultant assumes no responsibility for the accuracy of opinions of Cost Estimates and Client expressly waives any claims related to the accuracy of opinions of Cost Estimates. If Client wishes greater assurance as to Cost Estimates, Client shall employ an independent cost estimator as part of its Project responsibilities.

Opinions of Probable Cost. In providing opinions of probable cost (formerly referred to as cost estimates), the Owner understands that the CONSULTANT has no control over the contractor’s methods of pricing, or the cost of materials and labor, and that such opinions are provided on the basis of the CONSULTANT’s experience and qualifications. The Consultant makes no warranty, expressed or implied, as to the accuracy of such opinions as compared to bid or actual cost.
Opinions of Probable Cost. Any opinions of probable project cost or probable construction cost provided by ENGINEER are made on the basis of information available to ENGINEER and on the basis of ENGINEER's experience and qualifications, and represents its judgment as an experienced and qualified professional engineer. It is recognized, however, that the Consultant does not have control over the cost of labor, material, equipment, or services furnished by others or over market conditions or contractors' methods of determining their prices, and that any utilitarian evaluation of any facility to be constructed or work to be performed as part of the Project must of necessity be speculative until completion of detailed design. Accordingly, the Consultant cannot and does not guarantee that proposals, bids, or actual Project or construction costs will not vary from opinions, evaluations, or studies submitted by the Consultant to the Municipality hereunder. If the Municipality wishes greater assurance as to probable costs, then it shall employ an independent cost estimator.
Opinions of Probable Cost. Opinions of probable cost, cost estimates, and construction cost estimates provided herein are made based upon Kirkham Michael’s experience and qualifications as professional engineers. However, since Xxxxxxx Xxxxxxx has no control over the cost of labor, materials, equipment or services furnished by others, or over the contractor(s') methods of determining prices, or over competitive bidding or other market conditions, any opinions of cost shall be accepted by Client subject to Paragraph 3 of these General Terms and Conditions. In the event Client desires a level of accuracy of an estimate which establishes cost ceilings or detailed cost component analyses, Xxxxxxx Xxxxxxx will upon written authorization from Client secure the services of a specialized cost estimating and analyzing firm acceptable to Client. The Client shall agree to the payment of additional compensation as required.
Opinions of Probable Cost. 6.2.1 Because CONSULTANT has no control over the cost of labor, materials, equipment or services furnished by others, or over Contractor(s)' methods of determining prices, or over competitive bidding or market conditions, CONSULTANT's opinions of probable Total Project Costs and Construction Cost provided for herein are to be made on the basis of CONSULTANT's experience, qualifications and judgment as an experienced and qualified professional, familiar with the construction industry; but CONSULTANT cannot and does not guarantee that proposals, bids or actual Project or Construction Costs will not vary from opinions of probable cost. If prior to the Bidding or Negotiating Phase OWNER wishes greater assurance as to Total Project or Construction Costs, OWNER shall employ an independent cost estimator as provided in Attachment A.

Opinions of Probable Cost. The County hereby acknowledges that Engineer cannot warrant that any opinions of probable cost provided by Engineer will not vary from actual costs incurred by the County. The County understands that Engineer has no control over the cost or availability of labor, equipment, materials, or over market conditions or the Contractor’s method of pricing. Engineer makes no warranty, express or implied, that the bids or the negotiated cost of the work will not vary from Engineer’s opinion of probable cost.
Opinions of Probable Cost. All opinions of probable construction cost to be provided by SOM shall represent the best judgment of SOM based upon the information currently available and upon SOM's background and experience with respect to projects of this nature.
