This Amendment is for all purposes an “Operative Document” as defined in the Original Purchase Agreement, and all references to the “Agreement”, “Notes”, “Tranche 1 Notes” and “Tranche 2 Notes” in the Original Purchase Agreement shall include and incorporate this Amendment, as applicable.
