Common use of Operating Schedule Clause in Contracts

Operating Schedule. The Licensee shall keep the concession open and available for use by the public in accordance with the following schedule. The State or Division of State Parks & Reservoirs Director, or their designees must approve any deviation from the schedule in advance and in writing, unless circumstances beyond the control of either party make it necessary to take emergency action. In emergency situations, the Licensee must report the circumstances to the property manager immediately and in writing to the State as soon as practicable. In the case of inclement weather, and with the property manager’s approval, the concession may close early.
