OPERATING CHARGES. From and after the Commencement Date, Tenant shall pay to Landlord, as additional rent, Tenant's Proportionate Share of Operating Charges (as defined below). Such additional rent shall be paid within ten days after demand from Landlord or, at Landlord's option, in advance in monthly installments on the first day of each calendar month during the Term in an amount estimated by Landlord from time to time to provide funds sufficient to pay Tenant's annual obligation for such costs and expenses. Landlord shall deliver to Tenant a budget setting forth anticipated Operating Charges for the remainder of the first calendar year of the term of this Lease (an "Estimated Budget"). Prior to the commencement of each successive calendar year during the term of this Lease, Landlord shall deliver to Tenant an Estimated Budget for the upcoming calendar year. The Estimated Budget shall set forth the estimated Operating Charges in reasonable detail with respect to each category of expense. From time to time during the Term (but not more than once annually), Landlord may notify Tenant in writing of any reasonable adjustment in the monthly installments due hereunder, and thereafter Tenant shall make payments accordingly. Within ninety days after the expiration of each calendar year, or as soon thereafter as is reasonably practicable, Landlord shall provide Tenant a statement in reasonable detail showing the actual amount of additional rent, if any, payable by Tenant under this section 3.2, and showing the amounts with respect to the various categories of Operating Charges. Within ten days after such notice, Tenant shall pay to Landlord or Landlord shall credit against the obligations of Tenant or if at the end of the term, refund any excess amounts paid by Tenant, as the case may be, the difference between the estimated payments made by Tenant during the prior calendar year and the actual amount of additional rent due from Tenant as shown on such statement. Tenant's obligation for additional rent under this section 3.2 for the year in which the Term commences and ends shall be prorated based upon the number of days of the Term during such years. Tenant's obligation for additional rent under this section 3.2 through the Termination Date and Landlord's obligation to refund any excess amounts paid by Tenant shall survive termination.

OPERATING CHARGES. In addition to the Rent, the Lessee shall during the Term regularly and punctually bear and pay all charges for electricity and water consumed by the Lessee in the Unit in accordance with the electricity bills and water bills issued in respect thereof for which a separate meter is installed in the Unit by the Lessor.
OPERATING CHARGES as used herein shall further be defined as the total of (i) the cost to LESSOR of complying with LESSOR'S obligations under Article 22(a), (b), and (c) hereof (entitled COMMON AREAS Maintenance, Operation, Insurance and Taxes by LESSOR) plus (ii) an administration charge equal to ten percent (10%) thereof. Any increase in the costs otherwise includable in OPERATING CHARGES which are directly attributable to an OFFICE BUILDING tenant's wilful action or negligence, change of use in a unit within OFFICE BUILDING or alterations, additions and/or improvements to a unit within OFFICE BUILDING shall be excluded from OPERATING CHARGES computations.
OPERATING CHARGES as used herein shall further be defined as the total cost to LESSOR of complying with LESSOR'S obligations under Article 24(a), (b), and (c) hereof (entitled Common Areas Maintenance, Operation, Insurance and Taxes by LESSOR). Any increase in the costs otherwise includable in OPERATING CHARGES which are directly attributable to a Strip Center tenant's wilful action or negligence, change of use in a unit within Strip Center or alterations, additions, and/or improvements to a unit within Strip Center shall be excluded from OPERATING CHARGES computations.
OPERATING CHARGES. For the period commencing with the Sixth Amendment Expansion Effective Date and ending on the Termination Date, Tenant shall pay for its Proportionate Share of the Operating Charges applicable to the Sixth Amendment Expansion Space in accordance with the terms of the Lease, provided, however, during such period, the Operating Charges Base Year for the computation of Tenant’s Proportionate Share of Operating Charges applicable to the Sixth Amendment Expansion Space is 2000.
OPERATING CHARGES. For the period commencing on the Extension Date and ending in the Extended Termination Date, Tenant shall pay for its proportionate share of Operating Charges in accordance with the terms of the Lease, provided, however, during such period; the Operating Charges Base Year for the computation of Tenant’s proportionate share of Operating Charges shall be calendar year 2001.
OPERATING CHARGES. Agreed to be $6.00 per rentable square foot for the first Lease Year which are included in Base Rent. The Operating Charges shall be subject to yearly adjustment upward (but not downward) to reflect the annual percentage change in the CPI. Each such adjustment shall be accomplished (and shall be effective for the entire then operative Lease Year) by multiplying the Operating Charges for the Lease Year immediately preceding the next subsequent Lease Year (the “Operating Charge Adjustment Date”) by a fraction. The numerator of the fraction shall be the CPI figure for the month that is two (2) months prior to the Operating Charge Adjustment Date. The denominator of the fraction shall be the CPI figure for the month that is two (2) months prior to the Operating Adjustment Date for the previous Lease Year. Notwithstanding the foregoing, in no event shall any percentage increase in Operating Charges for any Lease Year be less than two percent (2%) or greater than four and one-half percent (4 ½%). Operating Charges shall include the following items: (1) electricity for the Common Areas, (2) sewer, (3) water, (4) HVAC, (5) janitorial services as set forth in Exhibit D attached hereto, (6) repair and maintenance of Common Areas and Building equipment, (7) snow removal, (8) repairs to the parking lot, (8) exterior landscaping maintenance, (9) Building property and other Landlord insurance as set forth herein, (10) administration and management of the Building and the Property, (11) cost of all other obligations required to be performed and all other services required to be provided by Landlord under this Lease, except as otherwise expressly stated herein.

OPERATING CHARGES. 3.1.1 From and after the Extension Term Commencement Date, Tenant shall pay as Additional Rent Tenant's Proportionate Share of the amount of Operating Charges for each calendar year to the extent falling within the Extension Term. Tenant's Proportionate Share with respect to Operating Charges shall be 56.60%, which has been calculated to be that percentage which is equal to a fraction, the numerator of which is the number of square feet of rentable area in the Premises and the denominator of which is the number of square feet of rentable area in the Building.
OPERATING CHARGES. 5.1 Tenant shall pay as additional rent to Landlord, Tenant's Proportionate Share (as defined in Section 1.3 above) of the amount by which Operating Charges (as defined in Section 5.2 below) during each Lease Year falling entirely or partly within the Lease Term exceed a base amount (the "Operating Charges Base Amount") equal to the actual Operating Charges for the first Lease Year (as adjusted pursuant to Section 5.4 below). Tenant's Proportionate Share is that percentage that is equal to a fraction, the numerator of which is the number of square feet of rentable area in the Premises, and the denominator of which is the number of square feet of rentable area in the Building, excluding the number of square feet of rentable area of any storage, roof or garage space.
OPERATING CHARGES. Tenant shall pay proratta share of operating charges associated with the building. The definition of the charges can be found in section 5.2. The current charge, due monthly, is $1.40 per s.f. or $770.00 per month
