Open Space Contribution. (a) The Vendor acknowledges and agrees that there will be no open space contribution required under section 50 of the Development Xxx 0000 (SA) in respect of any subsequent residential development undertaken on the Land in accordance with this Agreement (Open Space Contribution).

Open Space Contribution. The Developer shall strive to provide a minimum of ten percent (10%) of Open Space on the subject property, but in no event shall the Developer provide less than six and one-half percent (6.5%) of Open Space consistent with the requirements set forth in the Regulating Plan and Concept Book. Should the Open Space on the subject Property at completion of all phases of the proposed development or within five (5) years of the Effective Date of this Agreement, whichever is earlier, equal less than the aforementioned ten percent (10%) goal, then the Developer shall make a cash contribution to the City’s Public Parks and Open Space Trust Fund, as contemplated under Section 3.14.4.b.3 of Miami 21, at the rate of $10.81 per square feet for the square footage comprising the difference between the ten percent (10%) Open Space goal and the Open Space actually provided at or above the minimum requirement of six and one-half percent (6.5%) of Open Space on the subject Property.

Open Space Contribution. The Developer Parties shall strive to provide a minimum of ten percent (10%) of Open Space, but in no event less than six and a half percent (6.5%) of Open Space consistent with the requirements set forth in the Regulating Plan and Concept Book. Should the Open Space within the SAP Area at the completion of the Retail Street Project or within five (5) years of the Effective Date of this Agreement, whichever is earlier, equal less than the aforementioned 10% goal, the Developer Parties shall make a cash contribution to the City's Public Parks and Open Space Trust Fund at the rate of $10.81 per sq. ft., as contemplated under Sec. 3.14.4.b.3. of Miami 21, for the square footage comprising the difference between the 10% Open Space goal and the minimum requirement of 6.5%. The amount of said contribution shall not exceed $241,000 for the maximum anticipated deficit of 22,293 sq. ft. of Open Space and shall be apportioned among the Developer Parties in accordance with the method set forth in subparagraph (4).

  • Open Space Acquisitions within the PPA. The County agrees that for the term of this IGA it will not purchase or otherwise acquire any land within the PPA for open space purposes, including conservation easements and transfer of development right sending sites without the approval of the Town.

  • Built-up Area The built-up area for the Designated Apartment or any other Unit shall mean the Carpet Area of such Unit and Balcony area and 50% (fifty percent) of the area covered by those external walls which are common between such Unit/Balcony and any other Unit/Balcony and the area covered by all other external walls of the such Unit/Balcony.

  • Overtime Meal Allowance ‌ An employee who works two and one-half hours of overtime immediately before or following his/her scheduled hours of work shall receive a meal allowance of seven dollars. One-half hour with pay shall be allowed the employee in order that he/she may take a meal break either at or adjacent to his/her place of work.

  • PAYMENT ABATEMENT A. In the event that Concessionaire is unable to operate the Concession Premises as a direct result of the performance of, failure to perform or negligent performance by Department, its officers, agents, servants, and employees, of any act under the control or responsibility of Department, Concessionaire may be considered for an abatement of payment for the period that the Concession Premises cannot be operated. Circumstances for consideration of payment abatement shall include but not be limited to, disruption caused by Department construction activities in or around the Concession Premises and interruption of utility service as a result of actions by Department. Construction activities outside the control of Department and interruption of utility services by the utility service provider shall not be grounds for abatement. Suspension of Operations, as provided in Paragraph 9, shall not be grounds for abatement. Notwithstanding the circumstances, the decision whether or not to grant an abatement and the amount of any abatement lies completely within the discretion of Department.

  • Parental Allowance (a) An employee who has been granted parental leave without pay, shall be paid a parental allowance in accordance with the terms of the Supplemental Unemployment Benefit (SUB) Plan described in paragraphs (c) to (i), providing he or she:

  • Vacating Premises (i) If the Assuming Bank elects not to purchase any owned Bank Premises, the notice of such election in accordance with Section 4.6(a) shall specify the date upon which the Assuming Bank's occupancy of such premises shall terminate, which date shall not be later than ninety (90) days after the date of the Assuming Bank's notice not to exercise such option. The Assuming Bank promptly shall relinquish and release to the Receiver such premises and the Furniture and Equipment and Fixtures located thereon in the same condition as at Bank Closing, normal wear and tear excepted. By occupying any such premises after the expiration of such ninety (90)-day period, the Assuming Bank shall, at the Receiver's option, (x) be deemed to have agreed to purchase such Bank Premises, and to assume all leases, obligations and liabilities with respect to leased Furniture and Equipment and leased Fixtures located thereon and any ground lease with respect to the land on which such premises are located, and (y) be required to purchase all Furniture and Equipment and Fixtures owned by the Failed Bank and located on such premises as of Bank Closing.

  • Parental Leave Allowance (a) An employee who qualifies for parental leave pursuant to Clause 26.02, shall be paid a parental leave allowance in accordance with the Supplemental Unemployment Benefit (SUB) Plan. In order to receive this allowance, the employee must provide to the Employer proof of application and eligibility to receive employment insurance benefits pursuant to the Employment Insurance Act. An employee disentitled or disqualified from receiving employment insurance benefits is not eligible for parental leave allowance.

  • Site Allowance All new construction and extension/refurbishment work having a project value in excess of $2.0m will attract the then current City of Melbourne Site Allowance.

  • Cleaning Allowance The University will pay for the cleaning of Department issued uniforms and necessary work clothing requiring cleaning worn by employees assigned to non-uniformed positions.

  • Shoe Allowance The Employer will provide reimbursement to full time employees who have completed probation and who are employed in the kitchen and stewarding departments, once per year in the amount of $60.00 and once every two years in the amount of $60.00 for maintenance and banquet housepersons. The amount shall increase to $75, effective January 1, 2007. Employees will receive said amount as long as the shoes are approved by the employer and as long as the shoes are worn on the job. Payment will be made on or about July 1 upon presentation of proof of purchase.
