Old Business. 6.1 Feedback from the June 19, 2019 Oversight Committee Meeting Chair Xxxxx advised that the June 19, 2019 Oversight Committee meeting focused on the Draft Student Generation Rate/School Impact Fee Study Update (Study Update). She said after much deliberation, the Committee voted to move the Study Update forward to the School Board. Chair Xxxxx said the School Board acted to move the Study Update forward to Broward County with the school impact fee increases capped at 49%. Xx. Xxxxxxxx advised that the Study Update has officially been transmitted to Broward County. Ms. Xxx stated that the Study Update should be on the Broward County Local Planning Agency (LPA) meeting agenda in December 2019, the Broward County Commission agenda in January 2020, and if approved, will become effective 90 days after the January 2020 date. Xx. Xxxxxxxx said School District staff was very appreciative of Broward County staff’s support. He said the School District has added low income to the School Impact Fee Waiver process, increased the per project limit to $50,000 and increased the application waiver process to 60 days. Xx. Xxxxxxxx said the School District has designated $375,000 annually toward the school impact fee waiver program. He also stated that in the Study Update, school impact fees will not increase more than 49% in any category. Chair Xxxxx said the Oversight Committee had also discussed how often the Student Generation Rate/School Impact Fee Study should be updated. She said that when the issue came before the SWG, the consensus was that the group did not want to amend the TRILA, but they did not have an objection to extending the review period of the Study Update from three (3) to five (5) years. Chair Xxxxx said the Oversight Committee was in support of extending the review period to every five (5) years and requested that language be added to the Interpretation Document to reflect the change. She stated that an Amendment to the Interpretation Document would be brought back to the next scheduled Oversight Committee for a vote. Chair Xxxxx said there had been much pushback regarding the Study Update. She stated that Xx. Xxxxxxxx had been to various meetings to advocate against the Study Update using areas of law to support his argument. Chair Xxxxx advised that one of those areas was regarding an Auditor General Report stating that the School District was not demonstrating the rational nexus well enough to justify the expenditures of School Impact Fees on debt....
