OF WORKS. Where more than member have an interest in a recorded work, any member may obtain exclusive interest in the work by paying to the others a sum to be agreed among them, in which event the others shall have no interest in that recorded work. Where more than member have an interest in a recorded work, each member may exercise rights under this article with respect to contribution, provided that it is severable. A contribution is severable for this purpose if it could be erased without destroying the value of the other contributions to the same recorded work or if it could be replaced in the work by another contribution by someone else.
OF WORKS. The Builder agrees to execute and complete the Works in accordance with the Unit Floor Plans, Specification and Schedule of Finishes and in accordance with industry norms. The Owner shall in no manner whatsoever be entitled to interfere with, or allow any interference with the Builder, its’ employees, agents or subcontractors or with the completion of the Works, including but not limited to the giving of instructions or directions. Notwithstanding any provision to the contrary herein, the Builder shall be entitled to, without reference to the Owner, subcontract the whole or any part of its obligations in terms of this Agreement to any other person that it is in the opinion of the Builder qualified to execute the Works in a good, proper and workmanlike manner, but shall notwithstanding such appointment remain liable to the Owner as the Builder in terms of this Agreement. All specialists, merchants, tradesmen and sub-contractors who are to execute any work or supply any goods shall be contractors normally used by the main contractor appointed by the Builder. The main contractor shall be under no obligation to utilise the services of any other contractor or sub-contractor. The Owner, its officers, employees, agents and contractors shall not have any claim of any nature against the Builder or any of its officers, employees, agents and contractors for any loss, damage or injury which any of them may directly or indirectly suffer as a result of the execution of the Works (save in so far as such loss, damage or injury is caused through the Builder’s gross negligence). If any circumstances arising, caused by or attributable to the Owner, which delays or which could have the effect of delaying the completion of the Works, or of increasing the cost of the Works, the Builder shall have the right, without prejudice to any other rights which it may have in terms of this Agreement, to disburse monies due and owing and incur expenses on behalf of the Owner in order to facilitate the completion of the Works without first obtaining the consent of the Owner. All such monies disbursed or expenses incurred shall be payable by the Owner to the Builder on demand. The Builder shall within a reasonable time of disbursing such funds or incurring such expenses, notify the Owner of the nature and extent thereof.   • OF WORK The normal hours of work for an employee are not a guarantee of work per day or per week, or a guarantee of days of work per week. The normal hours of work shall be seven and one-half (7%) hours per day, and seventy-five (75) hours in any period. The normal daily tour shall consist of seven and one-half hours, exclusive of a one-half hour unpaid meal period. Employees shall be entitled to a fifteen (15) minute paid break during each half of the normal daily tour, at a time designated by the Employer. Employees required for reporting purposes shall remain at work for a period of up to fifteen (15) minutes which shall be unpaid. Should the reporting time extend beyond fifteen ( I 5) minutes however, the entire period shall be considered for the purposes of payment. Requests for change in posted work schedules must be submitted in writing and by the employee willing to exchange days off or shifts and are subject to the discretion of the Administrator or her designate. In any event, it is understood that such a change initiated by the employee and approved by the Employer shall not result in overtime compensation or payment or any other claims on the Employer by an employee under the terms of this t Where there is a change to Daylight Savings from Standard Time or vice-versa, an employee who is scheduled and works a full shift shall be paid for a seven and one-half (7.5) hour tour rather than the actual hours worked. The Employer will endeavour to accommodate requests by employees for specific days off and also requests for changes in posted time schedules once the schedule has been posted. Shift schedules shall be posted two (2) weeks in advance and shall cover a minimum of a four (4) week period. The following shall apply to full-time employees: During each pay period, two (2) consecutive days off will be scheduled. Schedules may provide for more than (5) consecutive days of work, but not more than seven (7) consecutive days of work without days off, as long as four (4) days off are scheduled in each fourteen (14) day period. Except as outlined below, meal time of one-half hour shall be scheduled away from the floor during the employee's shift whether day, evening or night. Where there is only one registered employee on duty, it is recognized that this is not possible. Should an employee be recalled to duty during meal time, additional time shall be provided later in the shift.

  • Xxxxx of Work The Contractor shall provide information technology (IT) independent verification and validation (IV&V) services to Customers in accordance with this Statement of Work (SOW). The Contractor shall provide the professional and technical staff necessary to perform the ((IT) IV&V services required by this Contract, and the staff shall have sufficient skill and experience to perform the services assigned to them. All of the (IT) IV&V services to be furnished by the Contractor under the Contract shall meet the professional standard and quality that prevail among IT professionals in the same discipline and of similar knowledge and skill engaged in related work under the same or similar circumstances.   • USE OF WORK PRODUCTS 2.13.1 The City may use all Documents that Contractor prepares or obtains under this Agreement. In addition, Contractor shall provide the Director with supporting schedules, flow charts or other analysis necessary to understand the reported findings and recommendations. Generally, this information is attached as exhibits to the final report; however, if requested by the Director, Contractor shall provide this information from its work paper files.

  • Completion of Works Buildings will be considered complete on the issue of the City’s Certificate of Occupancy. Other structures will be considered complete on the issue of the Company’s engineers notification of the completion of construction, and by the City’s certification.

  • LAYOUT OF WORK The Contractor shall lay out its Work from base lines and benchmarks indicated on the Drawings, and shall be responsible for verification of all measurements in connection with the layout. The Contractor shall furnish all stakes, templates, platforms, equipment, tools, materials, and labor required to lay out any part of the Work. The Contractor shall also be responsible for maintaining and preserving all stakes and other marks established by Princeton University until authorized to remove them. If such marks are destroyed by the Contractor or through its negligence before their removal is authorized, Princeton University may replace them and deduct the expense of the replacement from any amounts due or to become due to the Contractor.
