Occupancy Standards. To the extent legally possible, occupancy of the Affordable Units shall be limited to two persons per bedroom plus one additional person. Notwithstanding the foregoing, however, no residents of the Affordable Units as of the date of this Agreement shall be evicted from their apartment units solely because such residents do not meet the occupancy standards requirements of Section 307 of the Affordable Housing Agreement.

Homeowner shall not enter into an agreement for the rental, lease, or sublease of the Affordable Unit, and Homeowner shall not otherwise rent, lease, or sublease the Affordable Unit. The maximum number of persons permitted to occupy the Affordable Unit shall not exceed the occupancy permitted pursuant to the general requirements of the United States Department of Housing and Urban Development in effect on the Effective Date of the Density Bonus Agreement, which is two persons per bedroom, plus one person (e.g., for a two bedroom unit the maximum number of persons residing in the unit can be five). The minimum occupancy standard permitted for a two-bedroom unit is one person per bedroom. Homeowner shall, commencing upon the first anniversary of the date of this Covenant first set forth above and on each succeeding anniversary thereafter, submit to the City an affidavit of occupancy in a form provided by the City. The City may grant a temporary waiver of the above requirements for good cause, in the City's sole and absolute discretion.

Occupancy Standards. Notwithstanding other applicable requirements, occupancy of one bedroom Housing Units shall be limited to three persons, occupancy of two bedroom Housing Units shall be limited to five persons, and occupancy of three bedroom Housing Units shall be limited to seven persons. Notwithstanding the foregoing, however, no current residents of Housing Units as of the date of this Agreement shall be evicted from their apartment units solely because the household does not meet the occupancy requirements of this Section 306.
Occupancy Standards. All applicants must meet the established occupancy standards. As a general policy, there should be no more than two persons per bedroom. Management shall take into consideration mitigating circumstances in cases where applicants have children. For example, children under the age of 2 will not be counted, and the total number of person per unit may be expanded if there are especially large bedrooms or additional rooms that reasonably can be used as sleeping areas. Any family placed in a unit size different than that defined in these Occupancy Standards or if the household size expands during the lease, the resident shall agree to transfer to an appropriate size unit when one becomes available (in accordance with the Transfer Policy and Lease Addendum).

The maximum occupancy for a one-bedroom apartment in Xxxxxxx Residence Hall shall be two adults (defined as 18 and older) and one child, aged 5 or under; or one adult and two children, both aged 5 or under. TERMS OF CONTRACT Responsibility for the room and liability for rent will begin on the date stated on this contract and terminate on the date specified by this contract, unless special arrangements are made with the Seminary. HOUSING DEPOSIT AND MOVE OUT A housing deposit of $200 must be paid to the Business Office before keys to a room can be obtained. A housing deposit of $100 must be paid to the Business Office before keys to a unit can be obtained by a commuter resident. The deposit is payable by certified check, money order, traveler’s check, personal check, cash, or credit card (MasterCard or Visa only) or bank transfer (International students only). The Pay-by-Phone number is 0-000-000-0000. There is no extra fee to use this service. The housing deposit must remain on file with the Business Office during a resident’s entire term of residency. If for any reason the deposit is withheld or refunded during residency, the resident is responsible for re-submitting an appropriate deposit.
