Obligations Pursuant to Agreement Only. Nothing in this Section 10 shall be construed to mean that the Shareholder Servicing Agent would, by virtue of its role hereunder, be required under applicable law to maintain the records required to be maintained by it under this Section 10, but it is understood that the Shareholder Servicing Agent has agreed to do so in order to enable the Company and the Distributor to comply with laws and regulations applicable to them.
