Notification of Return from Leave. Any teacher who is scheduled to return to work from an approved leave under any of the provisions of this Article at the start of the following school year shall notify the District in writing of whether she/he is going to return or not return no later than March 1 for a full year leave and August 1 for partial year leave. The failure to provide such written notice by the applicable date may, at the Board’s discretion, be deemed as an abandonment of employment that xxxxxx the employment relationship.

Guarantee Return Parental leave without pay may be granted for a period not to exceed twenty (20) weeks in length, with a guarantee of return to the same position. Leave with position guarantee shall be granted only for reasons directly attributable to pregnancy or for the imminent and immediate adoption of a child. Leaves longer than twenty (20) weeks up to one (1) year entitle an employee to return to an equivalent position as defined in Article 10, section 6, subd 2. Compensation-related provisions of this Section shall be as follows:

The Board shall remind the teacher in writing by certified mail by March 1 of the teacher’s obligation to so notify the Board by April 1. A teacher failing to notify the Board in writing of his/her intent to return by the required time shall be irrefutably and irrevocably considered as having voluntarily resigned his/her employment with the District. Failure to abide by the conditions and dates specified for the leave will result in the termination of all rights of employment unless a variance has been granted by the Board at the request of the teacher.
