Notice to Proceed Date. The date that Design-Builder receives the Notice to Proceed.
Notice to Proceed Date. Subsequent to execution of a Job Order Contract by Owner and Contractor, the Owner will issue to the Contractor a written notice to proceed (the “Notice to Proceed”). The Notice to Proceed will authorize the Contractor to begin the Work identified in the Job Order Contract on the date specified in the Notice to Proceed. The Contractor will not begin Work on the Project until Contractor receives the Notice to Proceed. The Contractor shall complete the Work within the number of days specified in the Job Order, subject to extensions of time approved by the Owner through a Change Order. The time set forth for completion of the Work for each Job Order Contract is an essential element of the Job Order Contract.
Notice to Proceed Date. In the event that the Provider has not received the necessary financing for the System, secured appropriate interconnection rights, or the Notice to Proceed Date has not occurred within one (1) year following the Effective Date, either Party may terminate this Agreement upon thirty (30) days’ written notice to the other Party delivered at any time prior to the actual Notice to Proceed Date; provided, however, that the foregoing date shall be automatically extended on a day-for-day basis for any Force Majeure occurring after the Effective Date and prior to the Notice to Proceed Date. Notwithstanding the foregoing, Provider shall in good faith make all commercially reasonable efforts to secure all necessary financing and commence installation of the System within one (1) year following the Effective Date.

  • Notice to Proceed Work shall not commence on this Project until the Director has issued a written Notice to Proceed to the Recipient. Such Notice will not be issued until the Director is assured that the Recipient has complied with the Recipient's responsibilities concerning OEPA plan approval, when applicable. A Notice to Proceed shall be required for all project prime contractors or direct procurement initiated by the Recipient following execution of this Agreement.

  • Notice to Proceed - Site Improvements The Recipient shall not commence, or cause to be commenced, any site improvements or other work on the Land until the Director has issued a Notice to Proceed to the Recipient.   • Notice to Proceed - Land Acquisition The acquisition of the Land shall not occur until the Director has issued a written Notice to Proceed for land acquisition to the Recipient (the "Notice to Proceed"). Such Notice to Proceed will not be issued until the Director has received a Request to Proceed acceptable to the Director and is assured that the Recipient has complied with all requirements for the approval of a grant under Revised Code Sections 164.20 through 164.27 and any requirements for land acquisition set forth in this Agreement, including without limitation the OPWC's approval of the proposed Deed Restrictions and Title Agent. The Notice to Proceed also shall specify the time frame for the Closing.

  • Substantial Completion Date Substantial Completion of the Work as defined in Article 6.1.2 of the General Conditions to the Continuing Contract for Construction Management shall be achieved by July 31, 2022.
