Notice of Foreclosure. The Developer shall cause the Mortgage Holders to give not less than sixty (60) days’ prior written notice to the Town, by certified mail, of each Mortgage Holder’s intention to accelerate the indebtedness secured by its Mortgage, or to foreclose upon its Mortgage, or to accept a conveyance of the Land [and the Private Propertyif applicable] and the improvements thereon in lieu of foreclosure, in which event the Town shall have the right, but not the obligation to cure whatever default(s) have entitled the Mortgage Holder to take such action (subject to appropriation), which amount, together with the Town’s costs and expenses (including reasonable attorneysfees and expenses) shall be added to the amounts due to the Town pursuant to Section 8.02(e)(i) hereof. Notice of Foreclosure. A lender shall give the Tribe sixty (60) days’ notice of its intent to foreclose upon its mortgage or to accept a conveyance of the Property in lieu of foreclosure. During the sixty (60) day period, the Tribe, its successors or assigns, shall have the right, but not the obligation, to purchase the mortgage for the amount due hereunder (including applicable expenses), and in such event the lender shall deliver to the purchaser such assignments and other evidentiary documents as the purchaser shall reasonably request.

Notice of Foreclosure. Senior Lender will provide Subordinate Lender with written notice of any Foreclosure not later than the tenth day following commencement of such Foreclosure, and in any event not later than the tenth day prior to the sale or disposition in such Foreclosure. If such notice is provided late but prior to the tenth day before the sale or disposition, the sole remedy that Subordinate Lender shall have by reason of such lateness shall be to deliver to Senior Lender written notice of objection to such late notice within seven days of receipt of the same, whereupon the date of the sale or other disposition shall be continued for not less than the amount of time constituting the difference between the amount of notice that was given to Subordinate Lender and the amount that is required under this provision.
Notice of Foreclosure. The mort- gagee shall given written notice to the Commissioner within 30 days after the institution of foreclosure proceedings and shall exercise reasonable diligence in prosecuting such proceedings to completion. Any developments which might delay the consummation of such proceedings shall be promptly reported to the Commissioner.
