Common use of Notice by Company Clause in Contracts

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 14.

Notice by Company. The Company shall promptly notify in writing the Trustee and any Paying Agent of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 1412, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 1412.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 1411, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 1411.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities Notes or the purchase of any Securities Notes by the Company to violate this Article 14X, but failure to give such notice shall not affect the subordination of the Securities Notes to the Senior Indebtedness Debt as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14XIII, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 14XIII.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14XI, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 14XI.

The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness and Senior Subordinated Debt as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify in writing the Trustee and any Paying Agent of any facts known to the Company that would cause a payment of any obligations with respect to the Debt Securities or the purchase of any Securities by the Company to violate this Article 14XVI, but failure to give such notice shall not affect the subordination of the Debt Securities to the Senior Indebtedness as provided in this Article 14XVI.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Subordinated Securities or the purchase of any Securities by the Company Claim to violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Subordinated Securities and all Claims to the Senior Indebtedness as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company Debentures to violate this Article 14Thirteen, but failure to give such notice shall not affect the subordination of the Securities Debentures to the Senior Indebtedness as provided in this Article 14Thirteen.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent in writing of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 1412 or Section 11.02, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 1412 and Section 11.02.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14XI, but failure to give such notice shall not affect the subordination of the Securities to the Senior Secured Indebtedness as provided in this Article 14XI.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company Obligations to violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities Debentures to the Senior Indebtedness of the Company as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to Subsidiary Guarantees that violate this Article 14Eleven, but failure to give such notice shall not affect the subordination of the Securities Subsidiary Guarantees to the Guarantor Senior Indebtedness as provided in this Article 14Eleven.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14V, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 14.V.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company Claim to violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities and all Claims to the Senior Indebtedness as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify in ----------------- writing the Trustee and any Paying Agent of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 1412, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 1412.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 1412, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 1412.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to that violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 14Thirteen.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14XII, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 14XII.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14Thirteen, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 14Thirteen.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 1413, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 1413.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14Twelve, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 14Twelve.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to an Officer of the Company that would cause a payment of any obligations Obligations with respect to the Securities any Subsidiary Guarantee or the purchase of any Securities by the Company Claim to violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities Notes, the Subsidiary Guarantees and all Claims to the Senior Indebtedness Debt as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company [or the payment by any Guarantor on its Guarantee] to violate this Article 14[___], but failure to give such notice shall not affect the subordination of the Securities [and the Guarantees therefor] to the Senior Indebtedness Debt as provided in this Article 14[___].

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14XI, but failure to give such notice shall not affect the subordination of the Securities to the Senior Designated Secured Indebtedness as provided in this Article 14XI.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations principal or interest with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities Securi- ties to the Senior Indebtedness as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent in writing of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14(and the Company shall furnish a copy of such notice to the holders of the Senior Debt and their representatives), but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as Debt provided in this Article 14Article.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14ARTICLE XIII, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 14ARTICLE XIII.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company to Subsidiary Guarantees that violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities Subsidiary Guarantees to the Guarantor Senior Indebtedness as provided in this Article 14Eleven.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent (if other than the Trustee) in writing of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14VI, but failure to give such notice shall will not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 14VI.

Notice by Company. The Company shall will promptly notify the Trustee and the Paying Agent of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14XIV, but failure to give such notice shall will not affect the subordination of the Securities to the Senior Indebtedness Debt as provided in this Article 14XIV.

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities or the purchase of any Securities by the Company [or the payment by any Guarantor on its Guarantee] to violate this Article 14[__], but failure to give such notice shall not affect the subordination of the Securities [and the Guarantees therefor] to the Senior Indebtedness Debt as provided in this Article 14[__].

Notice by Company. The Company shall promptly notify the Trustee of any facts known to the Company that would cause a payment of any obligations with respect to the Securities Notes or the purchase of any Securities Notes by the Company to violate this Article 1415, but failure to give such notice shall not affect the subordination of the Securities Notes to the Senior Indebtedness as provided in this Article 1415.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent in writing of any facts known to the Company that would cause a payment of any obligations amount due with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14Article, but failure to give such notice shall not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 14Article.

Notice by Company. The Company shall promptly notify the Trustee and the Paying Agent (if other than the Trustee) in writing of any facts known to the Company that would cause a payment of any obligations Obligations with respect to the Securities or the purchase of any Securities by the Company to violate this Article 14‎VI, but failure to give such notice shall will not affect the subordination of the Securities to the Senior Indebtedness as provided in this Article 14‎VI.
