Note to Buyer. If exact rights to the parking and storage facilities is a concern to Buyer, Buyer should investigate.
Note to Buyer. Building Act 1975 - If no Pool Safety Certificate is received and the Contract proceeds to Settlement, it shall be the Buyer's responsibility to, at its own cost, obtain such certificate within 90 days (the usual period) or such further period after Settlement where section 246ATJ(2)(b) of the Building Act 1975 applies. The Buyer is referred to section 4 of the Form 36.
Note to Buyer. Do not initial here if you intend for your purchase of the Property to be contingent on your approval of the results of an inspection of the Property. Xxxxx obtaining a new loan from a financial institution to purchase the Property for a term no less than years [30 years if left blank] at an interest rate not to exceed percent per annum or on other terms and conditions reasonably acceptable to Buyer on or before the Closing Date and the appraisal being not less than the Purchase Price. Xxxxx agrees to apply for said loan no later days [5 days if left blank] following the Effective Date of this Agreement. Note to Buyer. It is encouraged that Xxxxx has the needed financing approvals in place prior to making an offer on the Property.
Note to Buyer. Do not initial here if you intend for your purchase of the Property to be contingent on the appraised value of the Property being no less than the Purchase Price. Buyer and its agents will have full access to the Property for the purpose of conducting Xxxxx's inspections. If: (i) Buyer is not satisfied, in its sole discretion, with the result of Xxxxx's inspections and/or Seller's response to Buyer's requests for repairs or other action (unless waived by Xxxxx as indicated by Xxxxx's initials above); (ii) if Buyer has not obtained the financing described above (unless waived by Buyer as indicated by Xxxxx's initials above); or (iii) the appraisal on the Property is less than the Purchase Price (unless waived by Buyer as indicated by Xxxxx's initials above), Buyer may terminate this Agreement by written notice to Seller given at any time before the applicable date set forth above, in which event the Xxxxxxx Money will be refunded to Buyer. If Buyer fails to give any such notices of termination within the applicable time period, the respective condition will be deemed satisfied or waived.
Note to Buyer. Do not initial here if you intend that Seller may use e-mail to deliver any required notices under this Agreement to you.
Note to Buyer. The Signing Payment Note shall include the following terms: (i) reductions for amounts paid to Harvest under the MSA; (ii) termination on obtaining the Nevada Approvals (i.e., Closing); (iii) matures on the date that Nevada regulators issue a final, non-appealable order not to allow the Nevada Approvals or the date that the Selling Parties and the Buyer determine that obtaining the Nevada Approvals is impossible; and (iv) automatic extension if parties are using good faith efforts to receive Nevada Approvals.
Note to Buyer. You are strongly advised to conduct investigations of the entire Property in order to determine its present condition since Seller may not be aware of all defects affecting the Property or other factors that you consider important. Property improvements may not be built according to code, in compliance with current Law, or have had permits issued.
Note to Buyer. Seller may amend Plan
Note to Buyer. 8.1 If there are existing walls and fences on the Land, then;
