Common use of Nonpayment Clause in Contracts

Nonpayment. Failure by any Borrower to pay any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to pay any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other Document;

Nonpayment. Failure by any Borrower to pay (a) any principal on the Obligations (including without limitation pursuant to Section 2.9) when due, or (b) any interest on the Obligations when due, whether at maturity or by reason of acceleration (including without limitation pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to pay Section 2.9) and any other liabilities fee, charge, amount or make any other payment, fee or charge liability provided for herein when due or in any Other Document;Document within three (3) Business Days of when such payments are due and owing.

Failure by any Borrower to pay any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to pay when due any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other Document;

Failure by any Borrower to pay any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to pay any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other Document;

Failure by any Borrower to pay any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to pay when due any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other DocumentDocument (violations of or related to the Formula Amount and/or the Borrowing Base Certificate shall be deemed to be a default under this Section 10.1);

Failure by any Borrower or Guarantor to pay when due (a) any principal or interest on the Obligations when due(including without limitation pursuant to Section 2.9), or (b) any other fee, charge, amount or liability provided for herein or in any Other Document, in each case whether at maturity or maturity, by reason of acceleration pursuant to the terms of this Agreement or Agreement, by notice of intention to prepay, prepay or by required prepayment or failure to pay any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other Documentprepayment;

Failure by any Borrower to (a) pay any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to (b) pay when due any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other Documentother Credit Document and such failure to pay when due any amount described in this clause (b) shall continue for three (3) Business Days;

Nonpayment. Failure by any Borrower to (a) pay any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to (b) pay when due any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other DocumentDocument and such failure to pay when due any amount described in this clause (b) shall continue for three (3) Business Days;

Failure by any Borrower to pay (i) any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to pay (ii) any interest on the Obligations or other liabilities or make any other payment, fee or charge provided for herein when due or in any Other DocumentDocument (other than any amount referred to in sub-clause (i) of this Section 9.1) when due and such failure shall remain unremedied for three Business Days;

Nonpayment. Failure by any Borrower to pay any principal or interest on the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure by any Loan Party to pay any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other Document;

Nonpayment. Failure by any Borrower to pay any principal principal, interest, or interest on reimbursement obligation with respect to the Obligations when due, whether at maturity or by reason of acceleration pursuant to the terms of this Agreement or by notice of intention to prepay, or by required prepayment or failure to pay any other liabilities or make any other payment, fee or charge provided for herein when due or in any Other Document;
