Common use of Non-Disturbance Clause in Contracts

Non-Disturbance. With respect to a Mortgage entered into by Landlord after the execution of this Lease, Tenant’s subordination of this Lease shall be subject to receiving assurance (a “nondisturbance agreement”) from the Mortgage holder that Tenant’s possession and this Lease will not be disturbed so long as Tenant is not in default and attorns to the record owner of the Premises.

Non-Disturbance. With respect to a Mortgage entered into by Landlord after the execution of this LeaseLease and to any and all advances made on the security thereof, and to all renewals, modifications, consolidations, replacements and extensions thereof, Tenant’s subordination of this Lease shall be subject to receiving assurance (a “nondisturbance agreement”) from the Mortgage holder that Tenant’s possession and this Lease will not be disturbed so long as Tenant is not in default and attorns to the record owner of the Premises.

Non-Disturbance. With respect to a Mortgage entered into by Landlord after the execution of this Lease, Tenant’s subordination of this Lease shall be subject to receiving assurance (a “nondisturbance non-disturbance agreement”) from the Mortgage holder Landlord’s lender that Tenant’s possession and this Lease Lease, including any options to extend the term hereof, will not be disturbed so long as Tenant is not in default Breach hereof and attorns shall attorn to the record owner of the Premises.
