Non-Compensable Curtailment. Except for Compensable Curtailment in accordance with Section 5.1.3, PacifiCorp shall not be obligated to purchase, receive, pay for, or pay any damages associated with, Net Output if such Net Output is not delivered to the System or Point of Delivery for any of the following reasons: (a) the interconnection between the Facility and the System is disconnected, suspended or interrupted, in whole or in part, consistent with the terms of the Generation Interconnection Agreement, (b) the Market Operator, Transmission Provider or Network Service Provider directs a general curtailment, reduction, or redispatch of generation in the area, (which would include the Net Output) for any reason (excluding curtailment of purchases for general economic reasons unilaterally directed by the Market Operator or PacifiCorp acting solely in its merchant function capacity), even if and no matter how such curtailment or redispatch directive is carried out by PacifiCorp, which may fulfill such directive by acting in its sole discretion; or if PacifiCorp curtails or otherwise reduces the Net Output in any way in order to meet its obligations to the Market Operator, Transmission Provider or Network Service Provider to operate within system limitations or otherwise, (c) the Facility's Output is not received because the Facility is not fully integrated or synchronized with the System, or (d) an event of Force Majeure prevents either Party from delivering or receiving Net Output (“Non-Compensable Curtailment”).

Non-Compensable Curtailment. PacifiCorp is not obligated to purchase, receive, pay for, or pay any damages associated with, Net Output not delivered to the Point of Delivery due to any of the following (collectively, “Non-Compensable Curtailment”): (a) the interconnection between the Facility and the System is disconnected, suspended or interrupted, in whole or in part, consistent with the terms of the Generation Interconnection Agreement; (b) the Facility is not fully integrated or synchronized with the System; (c) any direction to Seller by the Market Operator, Network Service Provider, Transmission Provider, Interconnection Provider or PacifiCorp (in its merchant function capacity and acting at the direction of the Market Operator, Network Service Provider, Transmission Provider or Interconnection Provider) to curtail Net Output: (i) to effectuate a reduction in transmission service by Transmission Provider as provided for under Transmission Provider’s Tariff; (ii) to effectuate a reduction in interconnection service by the Interconnection Provider as provided for under the Generation Interconnection Agreement; (iii) to maintain compliance with NERC, WECC or similar national or regional reliability standard requirements; or (iv) to remedy any condition or situation: (A) that in the judgment of the party making the claim is imminently likely to endanger life or property; or (B) that Transmission Provider determines in a non-discriminatory manner is imminently likely to cause a material adverse effect on the security of, or damage to Transmission Provider’s System, Transmission Provider’s or Interconnection Provider’s interconnection facilities or the electric systems of others to which the Transmission Provider’s System is directly connected; or (d) an event of Force Majeure that prevents either Party from delivering or receiving Net Output.

  • Compensable Rock CAUTION: No rock for which extra compensation is expected to be received shall be removed except pursuant to and in conformity with a written authorization or order of the Owner. Unless otherwise provided in the Bid Documents, no removal of rock as defined herein shall be included in the Bid. Shale, rottenstone, or stratified rock that can be loosened with a pick or removed by a hydraulic excavator equivalent to a Caterpillar Model 215, a single engine pan (Caterpillar 621 or equivalent) that is pushed by a crawler tractor (Caterpillar D-8K or equivalent), or similar equipment shall not be classified as rock.

  • Compensable Work-Related Injury or Illness Leave An employee who sustains a work-related illness or injury that is compensable under the state workers’ compensation law may select time-loss compensation exclusively or leave payments in addition to time-loss compensation. Employees who take sick leave, vacation leave or compensatory time during a period in which they receive time-loss compensation will receive full sick leave, vacation leave or compensatory time pay in addition to any time-loss payments. Notwithstanding Section 18.1, of Article 18, Leave Without Pay, the Employer may separate an employee in accordance with Article 31, Reasonable Accommodation and Disability Separation.

  • Pricing for Compensable Rock All compensable rock shall be priced by unit prices upon volume prior to removal and shall be calculated by survey and engineering calculations. No rock shall be priced by truckload, bucket load, or other similar pricing methods. Unit prices shall be determined prior to removal, either in the Contract Documents or by Change Order. Unit prices shall be inclusive of all profit and overhead, except for Time Dependent Overhead Costs. Unit prices shall include the following:

  • Catastrophic Leave - Natural Disaster Upon request of an employee and upon approval of a department director or designee, leave credits (CTO, vacation, personal leave, annual leave, personal day, and/or holiday credit) shall be transferred from one or more employees to another employee, in accordance with departmental policies, under the following conditions:

  • NATURAL DISASTER LEAVE 30.1 Where a permanent employee is unable to attend work because of a natural disaster, ie bushfire or flood, they will be entitled to be paid ordinary pay for the shift they would otherwise have worked on that day. This entitlement will apply once per calendar year and is not cumulative from year to year.

  • Disaster Relief Contract Violation Under Sections 2155.006 and 2261.053 of the Texas Government Code, PSP certifies that the individual or business entity named in the response or Agreement is not ineligible to receive the specified Agreement and acknowledges that this Agreement may be terminated and payment withheld if this certification is inaccurate.

  • Catastrophic Sick Leave Bank [a] The District will establish and manage a catastrophic sick leave bank from which eligible educators may draw leave under the conditions and restrictions outlined below. Teachers who wish to participate in the catastrophic sick leave bank program shall be required to contribute one (1) day of their available sick leave to the bank. This contribution must be made each year during the insurance open enrollment period, as designated by the District, by completing and submitting the appropriate form to the Human Resources Department. If the bank has a substantial balance of days remaining at the end of the academic year, the Association and District may agree to suspend the contribution requirement for one year. Any educator who did not previously participate in the bank but who desires to participate during the non- contribution year will be required to donate one (1) day to initiate eligibility by submitting the appropriate form to the Human Resources Department during the insurance open enrollment period, as designated by the District. [b] Only educators who have contributed to the bank and who have depleted their sick leave and personal leave balances shall be eligible to receive consideration for sick leave from the bank. [c] All requests for sick leave from the bank must be in writing and must be addressed to the Human Resources Director. Requests may be submitted and approved any time after the required sick leave has been contributed. The requests must include the reasons for the request, written verification from the attending physician indicating the nature and severity of the illness or health problem along with the projected recovery date, and the number of sick leave days requested. [d] Only severe, extended illness and catastrophic medical problems of an employee or immediate family member will be considered for leave withdrawals from the bank. Illness or medical problems of a short-term nature shall not be considered. Life-threatening illness or severe accidents requiring extended recovery periods will be given first priority. [e] Withdrawals from the bank for illness of the participating employee shall not exceed one hundred (100) leave days per employee during any four (4) year period. [f] Withdrawals from the bank for illness of an immediate family member shall not exceed twenty (20) days during any consecutive four (4) year period. For requests under this policy, immediate family members shall include husband, wife, son, daughter, father, mother, brother, sister, grandmother, and grandfather. In addition, exceptions may be considered by the Superintendent for other relatives or those who have virtually held the position of an immediate member of the family. [g] In all sick leave bank withdrawal requests, whether for the participating employee or for an immediate family member, the District reserves the right to approve requests, deny requests, or to approve only a portion of the leave days requested.

  • Collective Agreement ARTICLE 1 -

  • TERMINATION BY MPS - BREACH BY CONTRACTOR If Contractor fails to fulfill its obligations under this Contract in a timely or proper manner, or violates any of its provisions, MPS shall thereupon have the right to terminate it by giving five (5) days written notice before the effective date of termination of the Contract, specifying the alleged violations, and effective date of termination. The Contract shall not be terminated if, upon receipt of the notice, Contractor promptly cures the alleged violation with five (5) days. In the event of termination, MPS will only be liable for services rendered through the date of termination and not for the uncompleted portion, or for any materials or services purchased or paid for by Contractor for use in completing the Contract.

  • Non-Medicaid-Funded Hours Worked Effective July 1, 2021, the Employer shall contribute the Healthcare Rate or three dollars and seventy-nine cents ($3.79), whichever is higher to the Trust for each Non-Medicaid- Funded hour worked. Non-Medicaid-Funded Hour(s) worked shall be defined as all hours worked by all employees covered by this Agreement in the Employer's in‐home care program that are paid by a payor other than Medicaid, excluding vacation hours, paid-time off, and training hours. Effective July 1 2022, the Employer shall contribute the Healthcare rate or three dollars and ninety-eight cents ($3.98), whichever is higher, to the Trust for each Non-Medicaid-Funded Hour worked. Contributions required by Section 21.2 shall be paid periodically as required by the Trust.
