Franchisee’s FTTP Network currently passes 100% of the current households in the Franchise Area. At present, Xxxxxxxxxx’s anticipated schedule for making Cable Service available (with schedule dates measured from the month that the NY PSC issues the confirmation order approving this Franchise) calls for 93% availability at 6 months, 94% availability at 12 months, 94% availability at 18 months, 95% availability at 24 months, 95% availability at 30 months, 96% availability at 36 months, 97% availability at 42 months, 98% availability at 48 months, 99% availability at 54 months, and 100% availability at 60 months. This schedule is subject to further review and modification by the Franchisee consistent with Section 895.5(b)(1) of the NY PSC rules and regulations; provided, however, that Franchisee shall provide notice to the LFA and the NY PSC of any material change in this schedule.   • No waiver of our rights (a) No failure on our part to exercise and no delay on our part in exercising any right or remedy under this agreement will operate as a waiver of such right or remedy, nor will any single or partial exercise of any right or remedy preclude any other or further exercise of such right or remedy or the exercise of any other right or remedy.
