No Pending or Threatened Claims. To Seller's actual knowledge, ------------------------------- no litigation or claims of any kind are pending or threatened, and no facts or circumstances exist, that may in any way materially adverse affect the Real Estate, including material violations of regulations of the Environmental Protection Agency or any state regulatory body concerning the disposal of hazardous waste, petroleum, underground storage tanks, or any other hazardous materials at the Real Estate, except as disclosed in the Environmental Documents.
